2 actually applies to a portion of the real estate number that's identified in the application in the staff report because will actually be the new address for the lot after it's split from the larger parcel and it will be subject to all of the other ordinance code requirements, like going through the proper process for lot split. And we confirmed that with the owner and the applicant, so they're aware. So it was just a clarification I wanted to put on the record. THE CHAIRMAN: Great. I'm going to go ahead and open the public hearing. Is there anyone here to speak on anything on the consent agenda? AUDIENCE MEMBERS: (No response.) COMMISSIONER BRAMWELL: Yeah. Tim Bramwell. I'm a commissioner. THE CHAIRMAN: Thank you. We're going to go to the historic designation. I'll take a presentation. Blair, if you would. MS. KNIGHTING: Hello. So we have a landmark request for Mount Sinai Missionary Baptist Church at 0 Silver Street. You guys all have a little book in front of you with the staff report and our recommendation. Our recommendation is to approve. For those of you who may not have ever approved a landmark before, we have seven criteria, and those are listed in the book. And if the owner is in agreeance of the landmark, like they requested it or maybe the City has approached them for landmarking, we only have to meet two Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 of those seven criteria. If the owner is in opposition, they have to meet four of the seven. For this case, they are in agreement. They approached us. So they wanted the structure -- the reverend did. And so they wanted the structure to be a landmark. And it is actually located in the Springfield Historic District; however, it was built outside of the period of significance, and that's why it is not a contributing structure right now. So in order to get it protected, landmarking is the option. And so Joel McEachin wrote the report, and he, and also staff, has agreed that we believe that it meets three of the seven criteria. And, again, it only needs to meet two. So it meets three. And I'll quickly just kind of run through the three criteria we believe it meets and then you guys can make your decision. It is a significant -- let me read the actual criteria for you so we have that. A value as a significant reminder of the cultural, historical, architectural or archaeological heritage of the city, state or 0/0/0 0:: PM Page to of of sheets Diane M. Tropia, Inc., P.O. We believe this criteria is met by its continuing to be a church from the beginning when it was built and it is a great example of a community church in Springfield. They have had a great community outreach and they really are a cultural heritage icon in that area. And also with Springfield, there's a lot of churches that kind of left and they've stayed. They've stayed there and helped. And so that -- we believe it meets that criteria. The second criteria would be the distinguishing characteristics of an architectural style, value for the study of a period, method of construction or indigenous materials. This is a great example of an A-frame structure. I'll kind of just go through the pictures, maybe. It's a great example of an A frame, which was very common mid-century. It is part of the -- it was part of the mid-century, mid-modern movement, and the primary elements of the A frame with the support system commonly incorporated as a decorative feature of the interior, which I'll -- you will see pictures of that, if I can get this thing to -- it Diane M. 3 doesn't want to do what I want it to do. Let me see here. Okay. So back to my A frame. The front gable ends and sometimes the back is reserved for a full-height decorative window that fills the sanctuary with natural light. This particular A-frame structure was designed by an architectural partnership of Clyde Eugene Harris and Harvey Frye. And what's interesting about that architectural firm is in 00 Harris, which is Clyde Eugene Harris, was provided by the Jacksonville Chapter of AIA the Henry John Klutho Lifetime Achievement Award. So he was a very prolific architect during his time. And as you can see from the pictures, this is a great example of a mid-century A frame. I want to get to the interior photos. There's a ton of photos, so let's just kind of -- bear with me, please. And there has been an addition on the rear, which is sympathetic to it. And you can see that it's obviously an addition, but it is compatible. There's the beautiful interior. As you Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) can see, the decorative A frame trusses that are indicative of the A frame. And just so you know, I was the photographer. So I apologize if they're not great. Our camera is City issued. Okay? So -- but you can see it's a beautiful structure. So anyway -- so the third criteria is, is it worthy -- is it able to be preserved, is it -- suitability for preservation or restoration. And honestly, this church is in amazing condition. They're being great stewards. So it definitely meets that criteria as well. If you have any other questions, I'm here for you. THE CHAIRMAN: All right. Thank you. I am years old, almost as old as the church itself. And I would just like for our church to be a historical landmark so that -- to ensure generations to come of our history. Thank you. AUDIENCE MEMBER: They need your address now. Your address. MS. BROWN: My address? AUDIENCE MEMBER: Yes. MS. BROWN: Or the church address? AUDIENCE MEMBER: No. Your address. MS. I've been a member of that church for about years now, and we have -- it's in excellent condition to be of age of this. I saw the (inaudible). We had just done a lot of work in that church. We have re-varnished the stains of the A frame and we painted the outside, we put in new pews, and we have also put in new AC. We got -- we bought -- we spent almost $,000 in AC additions, so it's in tip-top shape, and -- thank you. THE CHAIRMAN: Thank you. Is anybody else here to speak on this? (Audience member approaches the podium.) AUDIENCE MEMBER: Good evening. It's certainly a blessing to be here to speak on our church because, really, it goes far and beyond. 4 because he's, you know, gone to be with the Lord, and I'm still there. And what it still does, you know, for all of us, and I'm just so pleased that things are happening to benefit our church, and we are really -- I'm really amazed as what the pastor leadership has done to motivate the children and has designated the full Sunday for them to actually perform. And I tell you, you would think that they're on TV the way they perform. And it's just really -- And what it has done in my life to communicate with God Almighty, and it makes a difference, especially with your husband being gone to be with the Lord, as long as we have known each other. But he's still with me, I understand that, and that's based on how I was taught in the church. So I'm just so delighted to be here, and I thank God for the opportunity. THE CHAIRMAN: Thank you. Is there anybody else here to speak on this? (Audience member approaches the podium.) AUDIENCE MEMBER: My name is George Diane M. Tropia, Inc., P.O. I'm the vice chair, deacon of the church, and also the business manager, and I would like to say that we have done great things and good things to preserve the church. We have put on a new roof. There is a new roof on the church. We keep the lawn cut -- excuse me -- we keep the exterior cut and trimmed and neat. We take care of the outside of the church very well, and we take care of the inside of the church very well. So I would like to have -- see that this church become a historical landmark in Jacksonville. Thank you. THE CHAIRMAN: Thank you. Is anyone else here to speak on this? We're going to move right along. MS. ELLER: Mr. Chair, if I could announce for the group, congratulations on the landmark status approved by the Historic Preservation Commission. It will also go to the full City Council. So we will -- the staff will be in touch with you as to when that will be scheduled for a public hearing. It does take a few weeks for the legislation to get filed, so it may be a few weeks before you get the firm date, but then it will be before the Land Use and Zoning Committee and then the full City Council as well. MS. ELLER: Thank you. THE CHAIRMAN: We're going to move right along. We have no COAs today. We do have a COA for work initiated or completed without a COA. That's COA--, Riverside Avenue. And, Blair, if you've got a presentation for me. MS. KNIGHTING: I do, if my PDF will work. All right. I don't know if you want to wait a minute to kind of get -- wait for everyone to -- THE CHAIRMAN: Sure. MS. KNIGHTING: Okay. So we have a COA without approval. They did the work without a COA first. My understanding from the applicant is that they were not aware that they needed a COA for a fence. The location, it is on the corner of Riverside and Talbot. Here is the site plan (indicating), as you can see it. Riverside, Talbot here. I don't know if you can see my little mouse. Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000

5 Anyway, the house is here (indicating). And so the fence starts at this right back corner, goes to the sidewalk, down the sidewalk to the driveway to the property owner's to the right. This is the front of the house (indicating). This is the side along Talbot. As you can see, it has these existing brick piers. The scope of work is -- they built the same fence that was there before. So that's one of the reasons why they didn't think they needed a COA. They were just building the fence back the way it was after hurricane damage. And there's the corner, here (indicating). So here it comes off the structure, down here to Talbot, back. And as you can see, it's foot. Here's a better picture (indicating). There's the site plan. This is what it looked like before (indicating). As you could see, after the hurricane it was kind of falling apart and there's testimony from the applicant that they had it -- a bungee cord. So that was how it Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 was before. This is before pictures (indicating). And then this is after. So I did want to state -- this is the survey (indicating). This is the recent survey. I have a survey here. I guess it didn't get in the book. I apologize. I thought I put it in the book. Is this it? Oh, this is the one. So the very first one, this one (indicating), is from. So, essentially, the fence has been there since before the district. However, it does not meet the fencing regulations that were put into place in 00 that state a privacy fence needs to be 0 feet away from that side elevation, that side, Talbot. As you can see by the site plan -- 00, excuse me, not 00. As you can see, it's right here along Talbot (indicating). It's on the sidewalk, instead of 0 feet back from the -- or the back corner of that house would be another way they could have done that, but the pool is in the way. So, technically, it -- it's -- we're Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 denying it because it doesn't meet the fencing regulations that were put in in 00. Any questions? COMMISSIONER DAVIS: Would they have been allowed to repair the fence? MS. KNIGHTING: We typically allow minor repairs of an existing fence, and that usually means one panel. COMMISSIONER KASPER: And so maybe -- through the Chair, clearly, the survey that was identified as this shows that the fence was always there and the brick columns were always there. MS. KNIGHTING: Uh-huh. COMMISSIONER KASPER: And so after the hurricane, the homeowner replaced the wooden panels with new wooden panels. MS. KNIGHTING: Yes. COMMISSIONER KASPER: So what I'm hearing from staff, the position is, you're treating this as a new fence or as a new work or -- MS. KNIGHTING: Yes. COMMISSIONER KASPER: -- a repair to -- MS. The columns are existing and the columns they didn't touch. COMMISSIONER DAVIS: Do we know how -- COMMISSIONER LOPERA: Well, through the Chair, so the fencing regulations would require them to construct a fence, a new one, 0 feet away from the sidewalk -- MS. KNIGHTING: (Nods head.) COMMISSIONER LOPERA: -- which is now where the columns are? MS. KNIGHTING: Exactly. COMMISSIONER LOPERA: Which could look odd. MS. KNIGHTING: Yes. COMMISSIONER LOPERA: Okay. COMMISSIONER BRAMWELL: Through the Chair, or lower. MS. KNIGHTING: Or they could reduce the height of the brick piers. They could do that. COMMISSIONER BRAMWELL: Maybe, what, feet? Diane M. 6 MS. KNIGHTING: Uh-huh. COMMISSIONER DAVIS: Do we know how old those brick columns are? MS. KNIGHTING: They're in the -- you can see, if you zoom in -- COMMISSIONER DAVIS: So we know at least. MS. KNIGHTING: Yeah. And it is a Marsh & Saxelbye structure, which tends to be a little bit more decorative, so it's not unusual to have a more decorative fence with brick columns. COMMISSIONER DAVIS: So is it possible that the brick columns are as old as the home itself? MS. KNIGHTING: Maybe. I don't know. I don't have -- I don't have -- I don't know that answer. COMMISSIONER KASPER: It may be asking an obvious question. As the board, do we have -- or as a commission, do we have leeway to grandfather in the fence that was there? And so, I guess, deny your denial or approve the fence as is? MS. ELLER: Yes. You could make findings Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 based on the criteria, based on the information that's been presented. You can use that evidence to support a granting of the COA. That is -- all of that is considered available competent substantial evidence. COMMISSIONER KASPER: So I would make the position that the fence was clearly there in '. It is complementary to the house with -- the brick columns are in a matching -- the fence is done in a clean and respectful manner. And so I would make the position to grant the fence to remain. COMMISSIONER LOPERA: Through the Chair, I do recall this commission approving an -foot fence behind the multifamily property within the last -- definitely within the last six months. And, of course, an foot was beyond our standard regulations of a -foot fence behind any property. So I would add that as competent evidence to approve this because this is a -- basically, it's just redoing what was already there before and something that happened long before this commission was established. It wasn't that we were trying to bypass the laws or anything because we love the area so much and we want to keep it the way it is, but it was due to our ignorance. We had only been there a year, and then the hurricane came in 0 and caused damage to the fence. And we just started off just to repair so many, and then we got into it and saw this other rotten wood and said we better just do it all at one time. You know, it was no intention to do anything illegal. You know, we just did it the wrong way, and I apologize for that, without coming to, you know, someone first and -- and doing it the correct way.
