2 Scope of the current criteria* Any rinse-off substance or mixture falling under the scope of Regulation (EC) No 1223/2009 intended to be placed in contact with the epidermis and/or the hair system with a view exclusively or mainly to: clean them (toilet soaps, shower preparations, shampoos) improve the condition of the hair (hair conditioning products) protect the epidermis and lubricate the hair before shaving (shaving products) * Commission Decision (EU) 2014/893 of 9 December 2014 establishing the ecological criteria for the award of the EU Ecolabel for 'rinse-off cosmetic products'

3 Background Regulation (EC) N 1223/2009 on cosmetic products Cosmetics are substances or mixtures intended to come into contact with the superficial parts of the human body (epidermis, hair systems, nails, lips and external genital organs) or with teeth and visible oral mucous membranes, solely or principally, to clean them, perfume them, modify their aspect, protect them, keep them in good condition or correct body odour (Chapter I Article 2 of Regulation (EC) N 1223/2009)

Alll rinse-off substances or mixtures within the scope of Regulation (EG) No. 1223/2009 of the European Parliament and of the Council that are designed for application on the skin and/or hair exclusively or mainly for cleaning purposes, to improve the condition of the hair or to protect the skin and moisten hair before shaving All cosmetic products covered by the EU Cosmetics Regulation 1223/2009 (i.e. soap, shampoo and toothpaste, or indirectly by washing bodies, hair or clothes, such as lotions, creams, hairstyling products and make-up), wet wipes as well as animal care products. Liquid and solid soaps, shaving cream and foams, facial toners, exfoliants, moisturizers, deodorants, cosmetics, nail polish and removers, tanning lotions, perfumes and cologne, sunscreen, insect repellents, personal hand sanitizers, oral hygiene products, hair shampoos and conditioners, hair treatments and styling products. This standard excludes personal care products not applied to persons. Single and multi-use wipes and cloths are not covered by this standard. Aerosols, including products packaging in pressurized cans or cans requiring the use of propellants are not accepted for certification. Natural and organic cosmetics This standard applies to all cosmetic products as they are defined by Regulation (EC) N 1223/2009 Cosmetic products (taken from Regulation (EC) No. 1223/2009) marketed as organic or natural and cosmetic ingredients with organic content.

7 Stakeholders opinions/interest have been gathered via a public survey Open from mid April 2018 mid June sent to EUEB members and CB on 8th June responses received

8 Key outputs from survey Respondent types 79% already familiar with the ROC criteria in some capacity 55 % industry, i.e. 34 respondants (big and small companies) 9 of them were license holders

11 Key outputs from survey Respondants from the industry Oral rinses may contain harmful chemicals for the environment (quaternary ammonium compounds, boric acid and triclosan). Enable ecolabelling without these chemicals would be beneficial for the consumer and the environment.

14 Key outputs from survey Respondents have, in general, a favourable opinion to expand the current scope Technical assesment should be carried out to assess the environmental benefit that could come from expanding the EU Ecolabel criteria for rinse-off cosmetics
