13 SALE TERMS AND CONDITIONS Guarantee: All cattle sell fully guaranteed in accordance with the suggested sale terms and conditions of the American Simmental Association adopted July Terms available upon request. Terms: The terms of the sale are cash or good check, payable in US funds. Settlement shall be made sale day. The possession of the cattle will not pass until it is made. Announcements: The auctioneer's announcements from the auction block will take presedence over printed material in the catalog. Up to date information will be provided sale day. Bidding: All animals sell to the highest bidder. The auctioneer will settle any disputes or challenges regarding bids, and his decision will be final. Risk : All animals are at owners risk and become the property of the purchaser. as soon as declared sold. Assistance will be given in loading and shipping of the animals, but no risk is assumed by anyone associated with the sale. Registry Certificates: Each animal is recored or in the event of baby calves, breeder's certificates will be furnished in the Herd Registry of the ASA, excluding steers. Simmental steers may have Performance Pedigree certificates. Crossbred steers may sell without certificates. All registrations will be transferred to new owner free of charge to buyer. Health: All cattle selling are coming from TB free herds or herds that have had a whole herd test. Animals selling will have either a metal TB tag or RFID tag. All females shall be calfhood vaccinated for Brucellosis. Consignors shall provide respective documents. Breeders Guarantee: Females cows represented as being "safe in calf" have been examined and declared safe by a licensed vet. They are considered breeders, without further guarantee. Cows and heifers represented as short bred are not guaranteed "safe in calf" but they and open heifers selling as individual lots are guaranteed to be breeders. No guarantee shall apply to sucking calves or females will carry calves full term nor that the calf carried will not be mummified. In no event shall the seller be responsible for damage caused by foreign bodies after the animal is sold nor for sickness not apparent at the time. Responsibility: The seller is the responsible party for all recommendations and warranties. The sale manager and auctioneer are acting as agents only and are not responsible in any way, but will endeavor to protect the interest of both buyer and seller. The seller or anyone associated in the sale shall not be responsible in case of accident resulting in injury to anyone attending the sale.
