As you are fully aware, I have posted a website titled, One Man s Fight against Corruption. This expanding website, currently at 275 pages, was first posted several years ago. If you Google Kym Heckman you will find on page one: Item 2 Episode 12 of my website titled, The Corruption and Cover-up involving Freeman Exposition Inc., OSHA of Nevada, Worker s Compensation of Nevada and the Teamster Union Local 631. If the succession of events surrounding the crushing injury to my left foot transpired as depicted in your investigation, there would not have been an injury! The elimination of any of the occurrences as described in your investigation report and I would not have been injured! The testimony of Dennis Love who was standing right next to me
3 when Don Reed recklessly crushed my left foot between the forklift platform and the rear of the truck trailer bed was completely disregarded in your inspection report. Dennis Love was in fact laid off by Freeman Exposition Inc. the very next day prior to your appearance for this Investigation. Dennis Love only worked four hours that day and was banned from returning to work by Freeman Exposition Inc.! At no time did you advise Dennis Love of his rights against retaliation by his employer! At no time was I ever included in the investigation of the crushing injury to my left foot! The Teamster Union Local 631 was never involved in your investigation. In fact the Teamster Union Local 631 was part of your cover-up! The end result was that you dropped both citations against Freeman Exposition Inc.! According to your Inspection Report the cause of the crushing injury to my left foot was that the forks on the forklift were 6 inches too short! This assessment on your part is a nauseating disgrace! As described in Episode 12 of my website your Mission Statement states, To assure the safety and health of America s workers by setting
4 and enforcing standards; providing training, outreach, and education; establishing partnerships; and encouraging continual improvement in workplace safety and health. Recently at the Convention Center, a close and personal friend was seriously injured in the parking lot when a scissor lift tipped over. As soon as I was made aware of this serious injury to my friend, I contacted OSHA by telephone and submitted a verbal request for an investigation. I know how OSHA operates and how the facts revolving the details of serious injuries to include fatalities is diminished to the extent that negligent employers don t even get a slap on the wrist! I am aware that the ineffective manner in which you conducted the investigation of the crushing injury to my left foot is representative of what is Standard Operational Procedure in all OSHA investigations! In our first and only conversation on the day that I was injured and reported my injury to OSHA, I made it very clear to you that I wanted to be proactive and involved in all phases of the investigation. The only proper manner to conduct any type of investigation is to arrange for a reenactment of what actually transpired with all parties present. Anything less reeks of corruption and cover-up That would have involved a forklift with a forklift platform attached and a truck trailer.
5 What is described in your inspection report and what actually transpired in the succession of events that caused the crushing injury to my left foot are not even remotely the same. Once again, the depiction of what transpired in your inspection report would not have rendered any injury to anyone it is a physical impossibility! It cannot happen! The end result of your investigation into the crushing injury to my left foot was that the forklift blades were 6 inches too short! Both citations written against Freeman Exposition Inc. were dropped by you and OSHA of Nevada. How do you and your cronies sleep at night? I have stated many times in court documents, in my website and elsewhere that the State of Nevada reeks of corruption and that this corruption is rampant! Your Inspection Report is a prime example of this corruption and is completely contrary to the ideals expressed in your Mission Statement. The stark reality is that the convention industry is a dangerous place to work. Serious injuries are commonplace, but are rarely reported to OSHA.
6 As a family owned business, Freeman Exposition Inc. has the ability to outbid their competitors and their profits are enormous! To maximize their profits, they are self-insured, reassured by the fact that they can control the labor unions, OSHA, Workmen s Compensation and the courts! I believe that that all these labor entities to include the courts are on the payroll of Freeman exposition Inc. Judging from your totally biased Inspection Report, I believe that you have also been on Freeman s payroll! I invite you to submit anything to counter this statement and prove me wrong. The fact of the matter is that you can not and your office in Henderson has a long history of treating other seriously injured workers, to include fatalities, in precisely the same manner that you conducted the investigation of my injury! Freeman Exposition Inc. is a family-owned multibillion-dollar company. They are in fact a prime example and the epitome of corruption in big business. May I remind you that your role and sole purpose is to provide a buffer between workers that are at risk from greedy and unscrupulous companies such as Freeman Exposition Inc.! There are numerous Teamster Journeyman that will not work for Freeman Exposition Inc.! To my knowledge, I am the only individual that has ever filed a
7 complaint with OSHA against Freeman Exposition Inc., after he was seriously injured due to the gross negligence of Freeman Exposition Inc. In retaliation, like Dennis Love, I was personally banned from returning to work by Freeman Exposition Inc. and this action was endorsed by Tommy Blitsch of the Teamster Union Local 631. I had a one-on-one sit down with Mike Feliciano, the head of Freeman s operations in Las Vegas. By the way, I noticed that you referred to him as Mike in your Inspection Reports! The day before this sit-down, Don Reed dragged a security guard over 30 feet by door 41 of South Hall at the Las Vegas Convention Center. Don Reed was the reckless forklift operator that crushed my left foot! During that sit-down conference, Feliciano concealed this information from me while we were negotiating my return to work for Freeman! Like you Feliciano was a trickster, a cheat and a liar! My left foot has never healed! I have to walk deliberately, if I speed up I start to limp. In order to be able to work, I require cortisone injections in my left foot every two months and a lot of pain pills.
