Our brand is synonymous with reliability and is supported by five key strategic issues: Health, Safety, Environment, Quality and Comfort. All Golden Night products are the result of production processes characterized following strict protocols at all stages of production, aimed at safeguarding the health of its customers as well as the environment and its employees. In fact, our brand ensures control of the entire production process starting from the selection of raw materials, which meet the high quality standards that the company aims for when creating high comfort products in a perfect mix of accuracy and high quality of workmanship. GENERAL CONDITIONS OF SALE ORDERS Submitting an order implies full acceptance of these conditions of sale, with NO exceptions - unless expressly agreed in writing. Orders sent to intermediaries, sales agents or directly to the company are accepted by us with the specific clause without the approval of the seller. Requests for special sizes or products will be considered on an individual basis. In case of customer error regarding orders or delivery, goods will only be replaced without cost to GoldenNight. ORDER CONFIRMATION AND DELIVERY GoldenNight s.r.l. will forwards an order confirmation to the customer indicating the terms of delivery effective from the date of confirmation, the mode of payment and any other information requested. Any changes to the order must be notified as soon as possible, and GoldenNight s.r.l. will send a replacement order confirmation. Goods are delivered at the risk of the buyer even if delivered carriage-free. The customer is therefore responsible for checking the goods at the time of delivery and forwarding any claims to the carrier. Delivery terms are indicative only and are not binding. Delays do not constitute grounds for any waiver or modification of the terms agreed and no claims for compensation can be made against the manufacturer. Changes to orders must be notified as quickly as possible. TRANSPORT Goods are delivered carriage-free for consignments totalling over 400.00. For smaller amounts a contribution to transport costs to the amount of 25.00 will be invoiced. PRODUCTS The products are those published and specified by type in our catalogue. Technological upgrades or product improvement measures may make it necessary for GoldenNight s.r.l. to make changes to its products, with no obligation to notify customers. Product sizes are expressed in centimetres; tolerances in the manufacturing process may result in slight variations to the sizes indicated for width, height and length, equal to 8%. Where it is necessary for a product to be glued, this will be carried out with no detrimental effect to the comfort of the product. The range of products is made largely of natural materials which may be subject to natural oxidation over time (a slight change of colour); this does not alter the individual properties of the product. Poor maintenance or excessive temperature changes may cause temporary hardening or softening of viscoelastic products. NON-STANDARD SIZES AND DELIVERY TIMES Requests for items of non-standard size and finish will be considered on an individual basis by GoldenNight s.r.l.; if the request is feasible the additional cost and date of delivery will be notified. PRICES Prices shown on the list are not inclusive of VAT and represent recommended prices to be charged by retailers. Each new list produced replaces any previous one. WARRANTY CLAIMS GoldenNight s.r.l. guarantees its products in accordance with European Directive 1999/44/EC implemented in Italy by Legislative Decree n.24/2002. This provides a warranty of two years if described as a private financial sale. The warranty covers any latent faults in the product, with the exception of faults caused by improper use (mishandling, tears, incorrect washing, mildew and stains of any type) and/or incorrectly following the maintenance instructions which are provided with each product. Any claims must be made in writing not later than 5 days from receipt of the goods. Faulty goods will be replaced with goods of the same type or having the same properties. The responsibility of GoldenNight s.r.l., in relation to defective products does not extend beyond the replacement of the defective goods; no claims for damage or penalties of any kind will be accepted. Returns for any reason must be authorised by GoldenNight s.r.l.; returns must be suitably packaged and accompanied by an explanation for the reason, with authorisation from the company. No returns will be accepted without prior authorisation from GoldenNight s.r.l. PAYMENTS The methods of payment are as agreed between the customer and GoldenNight s.r.l. at the time the order is placed and/or through dealers, and received by the company in writing. The dispatch of goods is independent of any other effect of payment. GoldenNight s.r.l. will have the right to withhold further deliveries if payment is delayed by the customer. Disputes that arises between the parties, including legal and authorised warranty claims, do not entail any extension to the agreed payment terms nor the right to suspend or modify payments; any action instigated by the customer may not be held prosecutable if the customer does not make efforts to comply with payment terms. DELAYS IN PAYMENT Where payments are late, the manufacturer is entitled to charge interest on the arrears. In the case of dispute, the buyer is not entitled to delay or refuse payment on the due date. Sales with deferred payment are considered conditional by the manufacturer until full payment is received. CONTRACT WORK Contract work is only used for plain dyed fabrics. Contract work is not used for leather items. For feasibility and prices please contact the GoldenNight s.r.l. office for authorisation. FRAMES Bed frames are made of plywood or poplar chipboard. The high-density polyurethane foam padding is coated with adhesive fabric. For models with removable covers, these can be made either in fabric or leather. LEATHER AND FABRICS The leather used for GoldenNight s.r.l. products is of the finest quality. Selected hides are treated at the tannery using modern dying techniques and workmanship. Marks such as creases or scars occur naturally in leather; every bed or leather item is individual because every hide has a different story that is revealed through the natural marks on the surface (scars, graining, shadows, scuffs, creases and natural variations in tone) that the tanner deliberately allows to remain in order to preserve its authenticity. To prevent discolouration, leather goods should not be placed close to any source of heat or exposed to direct sunlight. A fabric sample book is available with over 300 fabrics, showing the shades available, stain-resistant and washable fabrics, eco-leather, velour, linen and felt. BEDDING Our exclusive bedding is beautifully made and articles can be personalised with a wide range of designs. More than 500 colours are available in any combination. Fabrics used are: linen, satin, cotton, velour and felt. Our sample collection also includes: cushions, bolsters, throws, duvets and duvet covers. PRIVACY Personal data requested when submitting an order is collected and processed for the sole purpose of meeting customer requirements and will not be disclosed to third parties under any circumstances. GoldenNight s.r.l. guarantees its customers that legal requirements for the processing of personal data under the privacy code under Legislative Decree no. 196 of 30.06.03. will be respected. GoldenNight is the owner of the processed data. Customers may legally request to see any personal data held and ask for it to be updated, combined or deleted. TRIBUNALS Any action will be processed through the jurisdiction of the Court of Bari - Altamura Secondment Section.
