HARMONIZATION WITH THE EU ACQUIS Serbian Rulebook transposed in its entirety the DIRECTIVE 94/11/EC OF EUROPEAN PARLIAMENT AND COUNCIL of 23 March 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to labelling of the materials used in the main components of footwear for sale to the consumer 2/14
CURRENT LEGAL FRAMEWORK in RoS Serbia has aligned its legislation with DIRECTIVE 94/11/EC OF EUROPEAN PARLIAMENT AND COUNCIL of 23 March 1994 and adopt Rulebook on marking of footwear (Official Gazette of Republic of Serbia No. 1/14) promulgated on January 6, 2014, and came into force on January 14, 2014. The Rulebook shall apply as of July 1st, 2015. legal basis for this Rulebook: LAW ON TECHNICAL REQUIREMENTS FOR PRODUCTS AND CONFORMITY ASSESSMENT (Official Gazette of Republic of Serbia No. 36/09) 3/14
ADMINISTRATIVE AND INSTITUTIONAL FRAMEWORK RESPONSIBLE AUTHORITY in RoS for harmonisation and further monitoring/compliance with the EU acquis: Ministry of Economy of RoS RESPONSIBLE AUTHORITY for market surveillance: Ministry of Trade, Tourism and Telecommunications Currently, market surveillance authorities in Serbia have 100 trained inspectors in area for technical conformity assessment and product safety (including footwear products) 4/14
CONFORMITY ASSESSMENT BODIES for FOOTWEAR PRODUCTS IN SERBIA There are 11 accredited CABs in Serbia at the moment, out of which 7 accreditations are for inspection bodies for footwear products, and 4 for testing laboratories These bodies shall be used by manufacturers as well as by the market surveillance authorities in Republic of Serbia for determination of material used for three main components of footwear 5/14
NEW SERBIAN RULEBOOK SHORT DESCRIPTION OF THE CONTENT (1) New Serbian Rulebook lays down requirements for marking of the main components of footwear and material used in main components of the footwear that is intended for sale to the consumers, as well as requests for additional written information accompanying the footwear. 6/14
NEW SERBIAN RULEBOOK SHORT DESCRIPTION OF THE CONTENT (2) In second part of Serbian Rulebook, are requirements for additional written information accompanying the footwear, regarding size of footwear, name and address of the producer, intended use of footwear, manner of footwear care and the way of footwear is produced. This information's should be provided by manufacturer, or his agent, or importer, in Serbian language. The above mentioned part of the Rulebook constitutes a national addition to the EU regulation, provisions of which will cease to apply on the date of accession of Serbia to the EU. 7/14
GENERAL REQUIREMENTS FOR FOOTWEAR PRODUCTS When Footwear meets the marking requirements of this Rulebook for the main components of footwear and material used in main components of the footwear, it is placed on the market and/in use freely, without any restrictions. OLD NATIONAL LEGISLATION IN THE AREA OF FOOTWEAR On the date when the Rulebook shall become applicable, the following ceased to apply: 1)Rulebook of technical and other requirements for marking, declaring and packeging of finished leather and fur, products from natural and artificial leather (Official Gazette of RS, No 56/09). The extended application of (1) as well as transitional period for commencement of application of new Rulebook is necessary in order for Serbian market operators and consumers to adapt to the new set of requirements within new Rulebook which transposed EU DIRECTIVE 94/11/EC OF EUROPEAN PARLIAMENT AND COUNCIL of 23 March 1994. 9/14

PLANNED ACTIVITIES in RoS FOR THE UPCOMING PERIOD Activity: Measures planned: Preparation and organization of seminars and round tables for the industry and all stakeholders, including the market surveillance authorities, starting from 2014 and further on, to promote the Rulebook on marking of footwear, and educate the industry/stakeholders. As of June 2015, preparatory activities for market surveillance in accordance with new Rulebook, Continuous monitoring of European legislation in this area 13/13
