C HOUSE BILL lr By: Delegate Davis Introduced and read first time: February, 0 Assigned to: Economic Matters A BILL ENTITLED 0 0 AN ACT concerning State Board of Cosmetologists Licensing Hair Braiders, Cosmetology Assistants, and Microdermabrasion FOR the purpose of establishing a license endorsement to provide microdermabrasion services and a limited license to provide certain hair braiding services and certain limited cosmetology services; repealing certain provisions relating to a limited license to provide hair services; establishing qualifications for a senior esthetician; requiring the State Board of Cosmetologists to adopt regulations to establish certain standards for use by the State Board of Education or the Maryland Higher Education Commission in approving applications for instruction in the provision of certain hair braiding and microdermabrasion services at certain schools; establishing the scope of certain limited licenses and a certain license endorsement; establishing the qualifications of applicants for a limited license to provide hair braiding services or limited cosmetology services; authorizing certain applicants who hold a certain license in another state or foreign country to qualify for a certain license under certain circumstances; establishing the qualifications of applicants for a license endorsement to provide microdermabrasion services; establishing the application requirements for a certain license endorsement; requiring the Board to issue a certain license with a certain endorsement under certain circumstances; requiring licensees to submit certain evidence of compliance with certain continuing education requirements as a condition of license renewal; requiring the Board to establish certain continuing education requirements; requiring a certain beauty salon that provides hair braiding services to obtain a certain permit issued by the Board; prohibiting a person from providing hair braiding services, limited cosmetology services, or microdermabrasion services, or in certain locations; authorizing certain licensees to practice cosmetology and provide certain services in certain locations; requiring a certain licensee to be sponsored by a certain beauty salon in which the licensee is authorized to practice under certain circumstances; prohibiting a person from tattooing another individual in a beauty salon; adding and altering certain defined terms; making stylistic and conforming changes; and generally relating to EXPLANATION: CAPITALS INDICATE MATTER ADDED TO EXISTING LAW. HOUSE BILL limited licenses and a license endorsement issued by the State Board of Cosmetologists. BY repealing and reenacting, with amendments, Article Business Occupations and Professions Section, 0, 0, 0, 0, 0,,, 0, and 0 Annotated Code of Maryland (0 Replacement Volume and 0 Supplement) BY adding to Article Business Occupations and Professions Section 0. and 0. Annotated Code of Maryland (0 Replacement Volume and 0 Supplement) SECTION. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: Article Business Occupations and Professions. (a) In this title the following words have the meanings indicated. 0 0 (b) Apprentice means an individual who is learning to practice cosmetology or any limited practice of cosmetology in a beauty salon that holds a beauty salon permit under the supervision of: () if learning to practice cosmetology, a licensed senior cosmetologist; () if learning to provide esthetic services, a licensed senior cosmetologist or a licensed esthetician with years experience; () if learning to provide hair services, a licensed senior cosmetologist or a licensed hairstylist with years experience; and () if learning to provide nail technician services, a licensed senior cosmetologist or a licensed nail technician with years experience. (c) () Beauty salon means any commercial establishment, except a barbershop, in which an individual practices cosmetology. () Beauty salon does not include a clinic in a cosmetology school. (d) salon. Beauty salon permit means a permit issued by the Board to operate a beauty

HOUSE BILL (e) (f) [(g) Board means the State Board of Cosmetologists. Cosmetologist means an individual who practices cosmetology. Hairstylist means an individual who provides hair services.] (G) COSMETOLOGIST ASSISTANT MEANS AN INDIVIDUAL WHO PROVIDES LIMITED COSMETOLOGY SERVICES. (h) () License means, unless the context requires otherwise, a license issued by the Board. () License includes, unless the context requires otherwise, each of the following licenses: (i) (ii) (iii) [(iv) a license to practice cosmetology; a license to practice as a senior cosmetologist; a limited license to provide esthetic services; a limited license to provide hair services; and] (IV) A LIMITED LICENSE TO PROVIDE HAIR BRAIDING SERVICES; SERVICES; AND (V) A LIMITED LICENSE TO PROVIDE LIMITED COSMETOLOGY [(v)] (VI) a limited license to provide nail technician services. (i) Licensed cosmetologist means, unless the context requires otherwise, a cosmetologist who is licensed by the Board to practice cosmetology. 0 (j) Licensed senior cosmetologist means a person who: () has at least years of experience as a licensed cosmetologist; and () has passed a test approved by the Board. (k) () Limited license means a license issued by the Board to practice cosmetology as limited in 0 of this title. () Limited license includes, unless the context requires otherwise, each of the following licenses:

HOUSE BILL (i) [(ii) (II) a limited license to provide esthetic services; a limited license to provide hair services; and] A LIMITED LICENSE TO PROVIDE HAIR BRAIDING SERVICES; SERVICES; AND (III) A LIMITED LICENSE TO PROVIDE LIMITED COSMETOLOGY [(iii)] (IV) a limited license to provide nail technician services. (L) MICRODERMABRASION SERVICES MEANS TO ENGAGE IN, FOR COMPENSATION, A COSMETIC PROCEDURE DURING WHICH A MACHINE RAPIDLY DISCHARGES SUPER FINE CRYSTALS ON THE SURFACE OF THE SKIN TO REMOVE THE OUTERMOST LAYER OF SKIN AND VACUUMS AWAY THE CRYSTALS AND DEAD SKIN. [(l)] (M) () Practice cosmetology means to engage in any of the following for compensation: (i) (ii) (iii) (iv) (V) providing hair services; arching or dyeing eyebrows; dyeing eyelashes; providing esthetic services; [or] PROVIDING HAIR BRAIDING SERVICES; 0 (VI) PROVIDING LIMITED COSMETOLOGY SERVICES; (VII) PROVIDING MICRODERMABRASION SERVICES; OR [(v)] (VIII) providing nail technician services. () The practice of cosmetology does not include: (i) (ii) the mere sale, fitting, or styling of wigs or hairpieces; OR the mere shampooing of hair[; or (iii) a service that results in tension on hair strands or roots by twisting, wrapping, weaving, extending, locking, or braiding by hand or mechanical device, provided that the service does not include the application of dyes, reactive chemicals, or

[(m)] (N) Provide esthetic services means to provide to an individual, for compensation, the service of: () cleansing, exercising, massaging, stimulating, or performing any other similar procedure on the skin or scalp by electrical, mechanical, or any other means; () applying to the face an alcohol, cream, lotion, astringent, or cosmetic preparation; or () removing superfluous hair by the use of a depilatory, tweezers, or wax. (O) PROVIDE HAIR BRAIDING SERVICES MEANS TO PROVIDE TO AN INDIVIDUAL, FOR COMPENSATION, THE SERVICE OF BRAIDING THE HAIR OF THE INDIVIDUAL BY: () CLEANING THE HAIR; () COMBING OR BRUSHING THE HAIR; AND () PROVIDING A SERVICE THAT RESULTS IN TENSION ON HAIR STRANDS OR ROOTS BY TWISTING, WRAPPING, WEAVING, EXTENDING, LOCKING, OR BRAIDING BY HAND OR MECHANICAL DEVICE, PROVIDED THAT THE SERVICE DOES NOT INCLUDE THE APPLICATION OF DYES, REACTIVE CHEMICALS, OR OTHER PREPARATIONS TO ALTER THE COLOR OF THE HAIR OR TO STRAIGHTEN, CURL, OR ALTER THE STRUCTURE OF THE HAIR. [(n)] (P) Provide hair services means to provide to an individual for compensation the service of beautifying, cleaning, or embellishing the hair of the individual by: () arranging the hair; () bleaching the hair; () cleansing the hair; () coloring the hair; () curling the hair; () cutting the hair; () dressing the hair;

HOUSE BILL () singeing the hair; () permanent waving the hair; () waving the hair; or () performing any other similar procedure intended to beautify, clean, or embellish the hair. (Q) PROVIDE LIMITED COSMETOLOGY SERVICES MEANS TO PROVIDE TO AN INDIVIDUAL, FOR COMPENSATION, THE SERVICE OF: () ARRANGING THE HAIR; () CLEANSING THE HAIR; () CURLING THE HAIR; () DRESSING THE HAIR; () FINISHING THE HAIR; () SETTING THE HAIR; OR () SINGEING THE HAIR. [(o)] (R) Provide nail technician services means to provide to an individual, for compensation, the service of: () manicuring or pedicuring the individual s nails; () applying artificial nail enhancement products; or () maintaining artificial nail enhancement products. 0 (S) SENIOR ESTHETICIAN MEANS AN INDIVIDUAL WHO: SERVICES; AND () HAS AT LEAST YEARS EXPERIENCE PROVIDING ESTHETIC () HAS PASSED A TEST APPROVED BY THE BOARD. 0.

(a) HOUSE BILL In addition to any duties set forth elsewhere, the Board shall adopt: () bylaws for the conduct of its proceedings; 0 () regulations for qualification and examination of applicants for licenses, registration, and permits and issuance of licenses, certificates of registration, and permits; () regulations to govern the conduct of persons regulated under this title; () regulations to govern sanitation and safety in practicing cosmetology, including regulations that establish precautions to prevent the spread of infectious and contagious diseases; and () regulations to govern the direct supervision of the operation of limited practice beauty salons. (b) () The Board shall establish reasonable fees for licensing, licensing renewal, examinations, reinstatements, certifications, applications, preopening inspections, per diem fees for Board members, compensation for inspectors appointed by the Board, and for any other service performed by the Board necessary to carry out the provisions of this title. () (i) Except for the examination fees which the Board shall establish in amounts not to exceed the costs of the examinations and subject to subparagraph (ii) of this paragraph, the fees established by the Board shall be set in a manner that will produce funds sufficient to cover the actual direct and indirect costs of regulating the cosmetology industry in the State in accordance with the provisions of this title. that exceed $0. (ii) The Board may not set fees for licensing and license renewals 0 () The total cost of regulating the cosmetology industry in the State in accordance with the provisions of this title may not be more than the revenues generated by the fees established under paragraph () of this subsection. (c) () The Board shall adopt regulations that establish detailed curriculum standards for use by the State Board of Education or the Maryland Higher Education Commission in approving applications for instruction in the practice of cosmetology, the provision of esthetic services, THE PROVISION OF HAIR BRAIDING SERVICES, the provision of hair services, [and] THE PROVISION OF MICRODERMABRASION SERVICES, AND the provision of nail technician services at public schools or private career schools. () The curriculum standards established under paragraph () of this subsection shall: (i) incorporate modern methods and practices for:

HOUSE BILL. practicing cosmetology;. providing esthetic services;. PROVIDING HAIR BRAIDING SERVICES; [.]. providing hair services; [and]. PROVIDING MICRODERMABRASION SERVICES; AND [.]. providing nail technician services; (ii) include a reference to each topic and the emphasis of each topic required of a comprehensive curriculum in the appropriate licensing area; and Board. (iii) be reviewed and updated periodically as determined by the 0. (a) Except as otherwise provided in this title, an individual shall be licensed by the Board to practice cosmetology before the individual may practice cosmetology in the State. (b) () If an individual holds the appropriate limited license, the individual may practice cosmetology in a manner limited to: [()] (I) providing esthetic services; (II) PROVIDING HAIR BRAIDING SERVICES; 0 [()] (III) providing hair services; [or] (IV) PROVIDING LIMITED COSMETOLOGY SERVICES; OR [()] (V) providing nail technician services. () IF AN INDIVIDUAL HOLDS THE APPROPRIATE ENDORSEMENT BY THE BOARD, THE INDIVIDUAL MAY PRACTICE COSMETOLOGY AND PROVIDE MICRODERMABRASION SERVICES. (c) Subsection (a) of this section does not apply to: () a student while the student practices cosmetology in accordance with 0 or 0 of this subtitle; or

HOUSE BILL () a registered apprentice. 0. (a) To qualify for a limited license to practice cosmetology, an applicant shall be an individual who meets the requirements of this section. (b) An applicant for a limited license to provide esthetic services shall: () be at least years old; and () have completed successfully a th grade education or the equivalent; () have received training by: (i) serving as a registered apprentice for at least months as provided under 0 and 0 of this title; or (ii) successfully completing at least 00 hours of instruction in providing esthetic services in a cosmetology school approved by the State Department of Education or the Maryland Higher Education Commission in consultation with the Board. [(c) An applicant for a limited license to provide hair services shall: () be at least years old; and () have completed successfully a th grade education or the equivalent; () have received training by: 0 (i) serving as a registered apprentice for at least months as provided under 0 and 0 of this title; or (ii) successfully completing at least,00 hours of instruction providing hair services in a cosmetology school approved by the State Department of Education or the Maryland Higher Education Commission in consultation with the Board.] (C) AN APPLICANT FOR A LIMITED LICENSE TO PROVIDE HAIR BRAIDING SERVICES SHALL: () BE AT LEAST YEARS OLD; () HAVE SUCCESSFULLY COMPLETED A TH GRADE EDUCATION OR THE EQUIVALENT; AND

HOUSE BILL () HAVE RECEIVED TRAINING BY SUCCESSFULLY COMPLETING THE COURSES OF INSTRUCTION IN SAFETY AND SANITATION AND, AT MINIMUM, THE DISEASES OF THE HAIR AND SCALP AT A COSMETOLOGY SCHOOL APPROVED BY THE STATE DEPARTMENT OF EDUCATION OR THE MARYLAND HIGHER EDUCATION COMMISSION IN CONSULTATION WITH THE BOARD. (D) AN APPLICANT FOR A LIMITED LICENSE TO PROVIDE LIMITED COSMETOLOGY SERVICES SHALL: () BE AT LEAST YEARS OLD; () HAVE SUCCESSFULLY COMPLETED A TH GRADE EDUCATION OR THE EQUIVALENT; () HAVE RECEIVED TRAINING BY SERVING AS A REGISTERED APPRENTICE UNDER THE SUPERVISION OF A LICENSED SENIOR COSMETOLOGIST FOR AT LEAST MONTHS AS PROVIDED UNDER 0 AND 0 OF THIS TITLE; AND () PASS ONLY A PRACTICAL EXAMINATION. shall: [(d)] (E) An applicant for a limited license to provide nail technician services 0 and () be at least years old; () have successfully completed a th grade education or the equivalent; () have received training by: 0 (i) serving as a registered apprentice for at least months as provided under 0 and 0 of this title; or (ii) successfully completing at least 0 hours of instruction in providing nail technician services in a cosmetology school approved by the State Department of Education or the Maryland Higher Education Commission in consultation with the Board. [(e)] (F) If an applicant is licensed to practice as [hairstylist, or] A COSMETOLOGY ASSISTANT, an esthetician, A SENIOR ESTHETICIAN, A HAIR BRAIDER, A MICRODERMABRASION TECHNICIAN, OR A nail technician in another state or foreign country, the applicant meets the training requirements of this section if the applicant has

HOUSE BILL held a limited license in the other state or foreign country and has actively practiced in the other state or foreign country for a period of months. [(f)] (G) An applicant for a limited license shall pass an examination given by the Board under this subtitle. 0.. TO QUALIFY TO PROVIDE MICRODERMABRASION SERVICES AND OBTAIN AN ENDORSEMENT ON A LICENSE ISSUED BY THE BOARD, AN APPLICANT SHALL BE AN INDIVIDUAL WHO: () (I) IS A LICENSED SENIOR COSMETOLOGIST; OR (II) IS A SENIOR ESTHETICIAN; () HAS RECEIVED TRAINING BY SUCCESSFULLY COMPLETING INSTRUCTION IN A COURSE ON MICRODERMABRASION APPROVED BY THE BOARD; () HAS AT LEAST YEARS OF EXPERIENCE AS A MICRODERMABRASION OPERATOR UNDER THE SUPERVISION OF A LICENSED PHYSICIAN; AND () PASSES AN EXAMINATION REQUIRED BY THE BOARD. 0. (A) An applicant for a license: 0 () shall submit to the Board an application on the form that the Board provides; and () except as provided in 0 of this subtitle, shall pay to the Board or the Board s designee the appropriate examination fee established by the Board in accordance with 0 of this title in an amount not to exceed the cost of the required examination. (B) AN APPLICANT FOR AN ENDORSEMENT ON A LICENSE SHALL: 0 () SUBMIT TO THE BOARD AN APPLICATION ON THE FORM THAT THE BOARD PROVIDES; AND () PAY TO THE BOARD OR THE BOARD S DESIGNEE THE APPROPRIATE EXAMINATION FEE ESTABLISHED BY THE BOARD IN AN AMOUNT NOT TO EXCEED THE COST OF THE REQUIRED EXAMINATION.

HOUSE BILL 0 0. (A) If an applicant qualifies for a license under this subtitle, the Board shall send the applicant a notice that states that: () the applicant has qualified for the license; and () the Board will issue the license to the applicant on receipt of a license fee established by the Board in accordance with 0 of this title. (B) IF AN APPLICANT QUALIFIES FOR AN ENDORSEMENT ON A LICENSE UNDER 0. OF THIS SUBTITLE, THE BOARD SHALL SEND THE APPLICANT A NOTICE THAT STATES THAT: () THE APPLICANT HAS QUALIFIED FOR THE ENDORSEMENT; AND () THE BOARD WILL ISSUE THE LICENSE WITH THE ENDORSEMENT TO THE APPLICANT ON RECEIPT OF A LICENSE FEE ESTABLISHED BY THE BOARD IN ACCORDANCE WITH 0 OF THIS TITLE.. (a) () Subject to subsections (b)[, (c), and (d)] THROUGH (E) of this section and while a license to practice cosmetology is in effect, it authorizes the licensee to practice cosmetology. () WHILE A LICENSE TO PRACTICE COSMETOLOGY WITH AN ENDORSEMENT FOR MICRODERMABRASION SERVICES IS IN EFFECT, THE LICENSE AUTHORIZES THE LICENSEE TO PRACTICE COSMETOLOGY AND PROVIDE MICRODERMABRASION SERVICES. (b) () While a limited license to provide esthetic services is in effect, it authorizes the licensee to provide only esthetic services. () WHILE A LIMITED LICENSE TO PROVIDE ESTHETIC SERVICES WITH AN ENDORSEMENT FOR MICRODERMABRASION SERVICES IS IN EFFECT, THE LIMITED LICENSE AUTHORIZES THE LICENSEE TO PROVIDE ESTHETIC SERVICES AND PROVIDE MICRODERMABRASION SERVICES. [(c) While a limited license to provide hair services is in effect, the license authorizes the licensee to provide only hair services.]

HOUSE BILL (C) WHILE A LIMITED LICENSE TO PROVIDE HAIR BRAIDING SERVICES IS IN EFFECT, THE LIMITED LICENSE AUTHORIZES THE LICENSEE TO PROVIDE ONLY HAIR BRAIDING SERVICES. (D) WHILE A LIMITED LICENSE TO PROVIDE LIMITED COSMETOLOGY SERVICES IS IN EFFECT, THE LIMITED LICENSE AUTHORIZES THE LICENSEE TO PROVIDE ONLY LIMITED COSMETOLOGY SERVICES. [(d)] (E) While a limited license to provide nail technician services is in effect, it authorizes the licensee to provide only nail technician services.. (a) The initial term of a license is years. (b) A license expires on the date set by the Board unless the license is renewed for an additional term as provided in this section. (c) At least month before a license expires, the Board shall mail to the licensee, at the last known address of the licensee: () a renewal application form; and () a notice that states: (i) the date on which the current license expires; (ii) the date by which the Board must receive the renewal application for the renewal to be issued and mailed before the license expires; and 0 (iii) the amount of the renewal fee. 0 (d) Before a license expires, the licensee periodically may renew it for an additional year term, if the licensee: () otherwise is entitled to be licensed; () pays to the Board a renewal fee established by the Board in accordance with 0 of this title; [and] () SUBMITS TO THE BOARD SATISFACTORY EVIDENCE OF COMPLIANCE WITH THE CONTINUING EDUCATION REQUIREMENTS SET UNDER SUBSECTION (G) OF THIS SECTION FOR LICENSE RENEWAL; AND [()] () submits to the Board a renewal application on the form that the Board provides.

HOUSE BILL 0 (e) The Board shall renew the license of and issue a renewal certificate to each licensee who meets the requirements of this section. (f) () If an individual who, on or before September 0,, holds a limited license to provide esthetic services files an application to renew the license, the Board shall grant a waiver of the requirement for completion of hours of instruction under 0(b)()(ii) of this subtitle that are in addition to the hours of instruction required on or before that date. () If an individual who, on or before September 0,, holds a limited license to provide manicuring services files an application to renew the license, the Board shall grant a waiver of the requirement for completion of hours of instruction under [ 0(d)()(ii)] 0(E)()(II) of this subtitle that are in addition to the hours of instruction required on or before that date. (G) () IN ADDITION TO ANY OTHER QUALIFICATIONS AND REQUIREMENTS ESTABLISHED BY THE BOARD, THE BOARD SHALL ESTABLISH CONTINUING EDUCATION REQUIREMENTS AS A CONDITION OF THE RENEWAL OF LICENSES UNDER THIS TITLE. () THE BOARD SHALL REQUIRE A MINIMUM OF HOURS OF CONTINUING EDUCATION IN COURSES APPROVED BY THE BOARD. 0. (a) A person shall hold a beauty salon permit issued by the Board before the person may operate a beauty salon in the State. (b) A beauty salon may operate as a limited practice beauty salon by offering cosmetology services limited to: () providing esthetic services; [() providing hair services; or] () PROVIDING HAIR BRAIDING SERVICES; OR () providing nail technician services. 0 (c) operates. 0. A separate beauty salon permit is required for each beauty salon that a person

HOUSE BILL (a) Except as provided in 0 and 0 of this title and subsection (b) of this section, a person may not practice cosmetology, provide esthetic services, PROVIDE HAIR BRAIDING SERVICES, provide hair services, [or] PROVIDE LIMITED COSMETOLOGY SERVICES, PROVIDE MICRODERMABRASION SERVICES, OR provide nail technician services in any place other than: () a beauty salon that holds a beauty salon permit; or article. () a barbershop that holds a barbershop permit issued under Title of this (b) () A licensed cosmetologist, [hairstylist, or] COSMETOLOGIST ASSISTANT, esthetician, HAIR BRAIDER, MICRODERMABRASION TECHNICIAN, OR nail technician may practice cosmetology and provide services in: (i) a facility in which beautification oriented medical services, authorized by the Department of Health and Mental Hygiene, are provided; (ii) the residence of an individual confined to the residence by reason of a physical or mental infirmity; General Article; (iii) an assisted living facility as defined in of the Health Article; (iv) a hospice facility defined in 0(c) of the Health General 0 General Article; or (v) a nursing home as defined in 0(e) of the Health (vi) or a similar institution. a hospital as defined in 0 of the Health General Article 0 () To practice in any of the locations specified in this subsection: (i) the licensed cosmetologist, LICENSED SENIOR COSMETOLOGIST, COSMETOLOGIST ASSISTANT, esthetician, [hairstylist, or] SENIOR ESTHETICIAN, HAIR BRAIDER, MICRODERMABRASION TECHNICIAN, OR nail technician shall be sponsored by a beauty salon in which the cosmetologist, SENIOR COSMETOLOGIST, COSMETOLOGIST ASSISTANT, esthetician, [hairstylist, or] SENIOR ESTHETICIAN, HAIR BRAIDER, MICRODERMABRASION TECHNICIAN, OR nail technician is authorized to practice; (ii) of the beauty salon; and the patron to whom the services are rendered shall be a customer

HOUSE BILL beauty salon. (iii) the services shall be rendered by appointment through the 0.. (A) () IN THIS SECTION, TATTOO MEANS TO MAKE AN INDELIBLE MARK OR DESIGN ON THE SKIN OF AN INDIVIDUAL: (I) (II) BY THE INSERTION OF A PIGMENT UNDER THE SKIN; OR BY THE PRODUCTION OF SCARS. () TATTOO INCLUDES PERMANENT MAKEUP SERVICES. (B) A PERSON MAY NOT TATTOO ANOTHER INDIVIDUAL IN A BEAUTY SALON IN THE STATE. SECTION. AND BE IT FURTHER ENACTED, That this Act shall take effect October, 0.
