HANDOUT RINGKASAN CADANGAN PINDAAN PERATURAN-PERATURAN KESELAMATAN DAN KESIHATAN PEKERJAAN (PEGAWAI KESELAMATAN DAN KESIHATAN) 1997 DAN PERINTAH KESELAMATAN DAN KESIHATAN PEKERJAAN (PEGAWAI KESELAMATAN DAN KESIHATAN) 1997 1. Bagi pindaan Peraturan-Peraturan Keselamatan dan Kesihatan Pekerjaan (Pegawai Keselamatan dan Kesihatan) 1997, berikut adalah cadangan perubahan atau tambahan yang telah diadakan:- i. Terdapat dua (2) gred Pegawai Keselamatan dan Kesihatan iaitu Gred Pertama (First Grade) dan Gred Kedua (Second Grade). Bagi mana-mana SHO yang berdaftar dengan JKKP, apabila Peraturan tersebut dikuatkuasakan, secara automatik akan menjadi Pegawai Keselamtan dan Kesihatan Gred Kedua. ii. perubahan pada kelayakan yang diperlukan untuk pendaftaran sebagai SHO Gred Pertama atau Gred Kedua. iii. syarat yang diperlukan untuk kenaikan daripada SHO Gred Kedua ke SHO Gred Pertama. iv. Terdapat perubahan kepada keperluan untuk Continuous Education Programme (CEP) bagi tujuan pembaharuan pendaftaran. v. Ketua Pengarah JKKP untuk boleh enggan membaharui pendaftaran dan juga pembatalan pendaftaran SHO. vi. Majikan dan SHO hendaklah memberitahu Ketua Pengarah JKKP dengan cara bertulis, apabila samada dilantik, ditamatkan atau perletakan jawatan sebagai Pegawai Keselamatan. vii. SHO yang telah dibatalkan pendaftarannya, sijil pendaftaran Pegawai tersebut hendaklah diserahkan kepada pejabat JKKP yang terdekat. 1
viii. Salah laku (misconduct) SHO boleh dikenakan hukuman jika didapati bersalah. ix. Yuran yang dikenakan untuk mendapatkan sijil perdaftaran yang baru dan juga yuran proses verifikasi. 2. Manakala bagi pindaan Perintah Keselamatan dan Kesihatan Pekerjaan (Pegawai Keselamatan dan kesihatan) 1997, perubahan-perubahan adalah seperti berikut:- i.kerja pembinaan kejuruteraan (work of engineering construction) dan pengendalian bangunan ( building operation) telah diberi satu tafsiran baru. ii. Kelas industri telah diperluaskan mengikut Jadual 1 Akta Keselamatan dan Kesihatan Pekerjaan 1994. ii. Satu jadual telah diadakan bagi menerangkan keperluan untuk mengadakan gredgred tertentu SHO mengikut kelas-kelas industri. ------------------------------------------------------------------------------------------------------------------- 2

Skop dan Tujuan Pindaan Peraturan Mengkaji keperluan terkini dan melakukan penambahbaikan bagi memastikan peraturan dapat dikuatkuasakan dengan berkesan. Menyatakan kelayakan untuk mendaftar sebagai SHO, tanggungjawab dan akauntabiliti SHO dalam menjalankan tugas.
Qualification for registration New requirement Registration of SHO will be based on 2 grades: 1 st grade SHO Holds at least degree in OSH or equivalent from any professional body or institution approved by Minister, on the recommendation of DG; and Working experience at least 1 year in OSH.
2 nd grade SHO Holds any diploma in OSH or equivalent from any professional body or institution approved by Minister, on the recommendation of DG with working experience at least 3 years in OSH; or Holds any diploma from any professional body or institution and has successfully completed a training in OSH approved by DG and passed exam conducted by NIOSH and with working experience at least 3 years in OSH; Has been working in OSH area at least 10 yrs and passed exam conducted by NIOSH; or Holds other qualification or received training as prescribed by DG.
Qualification for upgrading New requirement All registered SHO before the amendment of this Reg. automatically be 2 nd grade SHO. The 2 nd grade SHO need to apply to DG to upgrade to 1 st grade SHO with conditions: Min. 5 yrs working experience as 2 nd grade SHO; and Pass verification process approved by DG. verification process means a process to evaluate an applicant to be entitled as 2 nd grade SHO or to upgrade 2 nd grade SHO to 1 st grade SHO.
Compulsory attendance in any CEP for renewal of registration Amendment SHO shall participate in CEP at least for renewal of registration. Deleted at least once in a year and attend
DG may refuse to renew registration Add new paragraph If the applicant: Failed to make an application to renew more than 3 months from date of expiry.
Cancellation of registration Add new paragraph DG may cancel the registration if SHO: Has not become a SHO exclusively at one place of work; Has been declared as bankrupt.
Surrender of certificate of registration New requirement SHO whose registration has been cancelled, shall surrender the certificate of registration to the nearest DOSH office.
Notification of SHO employment Amendment Employer & SHO must notify in writing to DG within 1 month of any: Appointment of SHO; or Termination or resignation of SHO.
Misconduct New requirement SHO be liable to a fine not exceeding RM5000 or to imprisonment not exceeding 6 months or both if: Fails to carry out the duties in Reg. 18 and 19; Delegates the duties to another person who is not a registered SHO; Fails to advice occupier or owner any defect which likely to cause any danger within his knowledge and scope; Caused damage or injury by careless operation or by neglect of routine; Intentionally falsifying any fact and info in his report or statement.
Replacement of new certificate of registration New requirement Fees will be charged for on certificate of registration if: Damage RM 50 Lost for 1 st time RM 100 Lost for 2 nd time & subsequent RM200
Processing fee for verification New requirement process If a person fails in 1 st verification process, the subsequent process will be charged RM50 fee.

Skop dan Tujuan Pindaan Perintah Bagi memperluaskan kelas dan jenis industri di mana majikan mengkehendaki mengambil kerja Pegawai Keselamatan dan Kesihatan (SHO) selari dengan yang terkandung dalam Jadual 1, AKKP 1994. Pindaan dilakukan dari segi kelas atau jenis industri dan jumlah bilangan pekerja yang dikehendaki mengambil kerja SHO.
