LCB File No. R175-99 PROPOSED REGULATION OF THE STATE BOARD OF COSMETOLOGY COSMETOLOGIST S APPRENTICE Applications. 1. A request for a certificate of registration as a cosmetologist s apprentice must be made in writing on form No. 5 provided by the board. 2. An applicant must provide to the board satisfactory proof that the applicant: a. Resides in Nevada in a county whose population is less than 35,000 and is required to travel more than 60 miles from his place of residence to attend a licensed school of cosmetology; b. Is not less than 16 years of age at the time of application; c. Is of good moral character; and d. Has successfully completed at least the 10th grade high school education or its equivalent. 3. The application must be accompanied by two current photographs of the applicant which are 1-1/2 by 1-1/2 inches. The name and address of the applicant must be written on the back of each photograph. Petition to supervise a cosmetologist s apprentice; qualifications of a licensed cosmetologist to supervise and train; approval of cosmetology establishment to train cosmetologist s apprentice. 1. To supervise and train a cosmologist s apprentice, a person must petition the board in writing on form No. 6 provided by the board. 2. The petitioner must provide to the board satisfactory proof that he: a. Is licensed by the board in cosmetology; --1--

b. Has practiced cosmetology in this state for not less than 3 years immediately preceding the date of the petition and that during such time his license has been in good standing; c. Resides in Nevada in the same county as the cosmetologist s apprentice whom he seeks to supervise; and d. Currently works in or operates a licensed cosmetology establishment in which all the occupations of cosmetology are practiced. 3. The petition must be accompanied with a statement from the owner of the cosmetology establishment authorizing the training of a cosmologist s apprentice in such establishment. Requirements of supervision and training. 1. A licensed cosmetologist who has been authorized by the board to supervise and train a cosmologist s apprentice shall: a. Keep track of the cosmetologist s apprentice s attendance; b. Provide practical training and technical instruction in the subjects and for the hours listed below: 1. Blow drying, 160 hours; 2. Dispensary, 50 hours; 3. nail extensions and wrapping, 40 hours; 4. Facials, archings, skin care and make-up, 120 hours; 5. fingerwaving, 120 hours; 6. Hair coloring, 400 hours; 7. Hair cutting, 450 hours; 8. Manicuring, 150 hours; 9. Miscellaneous practical and technical instruction, 180 hours; 10. Modeling, 60 hours; 11. Nevada law and regulations, 40 hours; 12. Pedicuring, 50 hours; --2--

13. Permanent waving and chemical straightening, 500 hours; 14. Receptionist s duties, 50 hours; 15. Salon management, 50 hours; 16. Scalp treatments, 50 hours; 17. Shampooing and rinses, 50 hours; 18. Skip waving, 120 hours; 19. Theory, 410 hours; 20. Thermal straightening, curling and marcelling, 300 hours; 21. Wet hairdressing, 200 hours; and 22. Wigs and hairpieces, 50 hours. c. Provide monthly tests on theory and practical curriculum; d. Submit monthly reports to the board, signed by both the supervising cosmologist and cosmetologist s apprentice, which summarize the cosmetologist s apprentice s attendance and training during the reported month, including test scores; e. Ensure the cosmetologist s apprentice at all times wears a clean outer garment and a badge pursuant to NAC 644.XXX; f. Ensure the cosmetologist s apprentice s certificate of registration is in plain view of the public at the position where he performs his work; g. Limit the cosmetologist s apprentice s training to 40 hours per week or 5 days out of every 7 consecutive days; h. Not commence training unless the cosmetologist s apprentice holds a valid certificate of registration. i. Upon completion of the apprentice training, submit to the board with the cosmetologist s apprentice s application for examination a final report, which summarizes the training, provided to the cosmetologist s apprentice and his achievement of the training goals. Limitations on the practice of cosmetology by a cosmetologist s apprentice. --3--

1. Prior to practicing cosmetology on the public, a cosmetologist s apprentice must have received at least 350 hours of training covering all areas of cosmetology. 2. A cosmetologist s apprentice may not commence training until or perform work on the public unless his certificate of registration is placed in plain view of the public at the place he performs his work. Act or omission of cosmetologist s apprentice responsibility of supervisor; grounds for discipline. 1. For purposes of this chapter, the act or omission of any cosmetologist s apprentice shall be deemed, unless contrary intent appears otherwise, the act or omission of the supervising cosmetologist. 2. A violation of the provisions of this chapter by a supervising cosmetologist may be grounds for the revocation or suspension of the supervising cosmologist s licensee. Inspection of cosmetology establishment in which training of cosmetologist s apprentice will occur; minimum requirements. 1. Prior to the commencement of training of a cosmetologist s apprentice at a cosmetology establishment, an inspector of the board will inspect the premises of the cosmetology establishment. 2. To be authorized to provide training of a cosmetologist s apprentice, a cosmetology establishment shall have available in a designated area for the cosmetologist s apprentice s use during the training period the following items: a. One styling chair; b. One shampoo bowl; c. One blow dryer and one hood dryer; d. One manicuring table; e. Supplies for wet and dry sterilization acceptable to the board; f. Hot work equipment consisting of: --4--

1. An electric heater; 2. Pressing comb; 3. A curling iron (marcel); and 4. Protective cream or jelly; g. Cold wave equipment and supplies which must be maintained in sufficient quantity to block, wrap and complete one permanent wave, including rollers and rods and end papers and cotton; h. Tinting equipment and supplies, including tint bowl with tint brush and 2 applicator bottles; i. Facial supplies, creams and lotions; j. One mannequin; k. At least one standard textbook, a law book and adequate reference material; l. Combs and brushes for all services; m. Tapering shears; n. Neck strips; o. Scissors; p. Razor and blade with guard; q. Plastic spray bottle; r. Band-Aids; s. Protective gloves; t. Clippies; u. Hot waxing equipment; v. Oils and conditioners consisting of: 1. Pressing oils; 2. Scalp conditioners; 3. Scalp conditioners (not having a soap base) for pressed hair; --5--

4. Hair conditioners (not having a soap base) for pressed hair; 5. Curling creams (wax); and 6. Dry cleaning fluids for pressing hair; w. One heat cap for treatment; x. A covered container for hairpins, clips, nets and similar items; y. One shampoo cape; z. Containers for sanitizer to submerse instruments; and aa. Sufficient manicuring and pedicuring supplies, including 1. Emery board; 2. Cuticle cream; 3. Base coat; 4. Topcoat; 5. Nail polish; 6. Manicuring water bowl; 7. Container for sanitizer to submerse instruments; 9. Orangewood stick or cuticle pusher; and 10. Tips, wraps, extensions and sculptured nails. Badge. Each cosmetologist s apprentice shall wear a badge with contains the name and photograph of the cosmetologist s apprentice, his certificate of registration number and the name of his supervising cosmetologist. Extension of Certificate of Registration and authorization to supervise; Termination of Certificate of Registration; credit for incomplete hours in training; waiver of fees. 1. A certificate of registration is valid for 2 years after the date on which it is issued and may be extended by the board prior to its expiration only upon good cause shown. 2. Authorization of a cosmetologist to supervise a cosmetologist s apprentice is valid for the --6--

period during which the cosmetologist s apprentice holds a valid certificate of registration. 3. If training of the cosmetologist s apprentice ceases prior to completion of the apprentice training and instruction, the cosmetologist s apprentice s certificate of registration shall terminate. At the discretion of the board, the cosmetologist s apprentice may apply any training hours earned to a new certificate of registration, provided no credit will be given for training hours earned 4 years or more prior to the person applying for a subsequent certificate of registration. Upon good cause shown, the board may waive application fees for a subsequent certificate of registration. Misrepresentation of cosmetologist s apprentice; advertising. 1. A cosmetologist s apprentice, supervising cosmetologist or cosmetology establishment shall not misrepresent to the public the cosmetologist s apprentice s authorization to perform cosmetology services. 2. A misrepresentation to the public of the cosmetologist s apprentice s authorization to perform cosmetology services may be cause for revocation of the cosmetologist s apprentice s certificate of registration and revocation of the license of the supervising cosmetologist or cosmetology establishment. 3. A cosmetologist s apprentice s failure to properly display his certificate of registration or wear his badge or a supervising cosmetologist s failure to ensure the proper display of the cosmetologist s apprentice s certificate of registration or badge shall be deemed a misrepresentation to the public. --7--
