1 COMMUNITY ENVIRONMENTAL HEALTH POLICY COMMITTEE I. Committee Description YEAR PREPARED: AUGUST 3, ANNUAL REPORT - The Community Environmental Health Committee (CEHC) addresses a broad variety of issues, some of which do not fit neatly into a single environmental health program area. For example, the scope of disaster preparedness and response spans most aspects of environmental health practice. II. Committee Members See Attachment One for current committee and TAC membership. III. Committee Programs 1 A. Programs Active during Reporting Period Body Art Recreational Health Organized Camps Housing (includes indoor air, lead, mold, radon, bedbugs) B. Programs Inactive during Reporting Permit Occupational Health Vectors, including West Nile Virus Homeland Security, including Bioterrorism Environmental Health Tracking Noise Disaster Preparedness and Response Electromagnetic Fields Lead Program Institutions Program Employee Housing Program Indoor Air (Radon) Program Substandard Housing Program Radiation Program 1 Programs within the committee are identified in Appendix 4 of the CCDEH/CAEHA Procedure Manual (2011) that can be found at

Roles and Responsibilities 2 The broad scope of the committee s program involvement requires a decentralized committee structure involving a variety of specialty Technical Advisory Committees (TACs) and committee members taking lead roles in TAC liaison and the committee chair playing a facilitative and coordinating role. A. TACs Active during Reporting Period Body Art Recreational Health TAC - Southern California Recreational Health TAC Bay Area California B. TACs Inactive during Reporting Period Homeland Security Vector Issues In addition to the TACs, a Body Art Working Group was established during this reporting period. The Working Group is an informal advisory body composed on members of the Body Art TAC and body art practitioners and educators from the private sector. V. Committee Accomplishments A. Public Swimming Pool Update On January 18, 2012 the California Building Standards Commission approved a set of changes to Title 24, updating standards for public pool construction. The Bay Area TAC held a meeting on the same day as the hearing so that TAC members could attend the CBSC meeting in support of the proposed changes. The meeting was attended by Environmental Health staff from 13 jurisdictions supporting the changes. B. Safe Body Art Law On October 9, 2011, Governor Brown signed AB 300 (Ma) which enacts the Safe Body Art Law. This is welcome news after two previous attempts were vetoed by the previous Governor. Much thanks was given to the four sponsors of the law: California Association of Environmental Health Administrators, Health Officers Association of California, Association of Professional Piercers and Alliance of Professional Tattooists, as well as the support of CCDEH. The new law took effect on January 1, 2012 and body art practitioners were given until July 1, 2012 to comply with the registration and permitting requirements. Under the direction of Justin Malan, CCDEH Executive Director, and Kiowa Borja, Ecoconsult Office Manager, a Body Art Steering Committee was formed and 13 workshops were held throughout the state between January and, May, Roles and responsibilities of CCDEH committees are described in Appendix 1 of the CCDEH/CAEHA Procedure Manual (2011) that can be found at
3 PAGE 3 The workshops were a collaborative effort of local Environmental Health staff, body art practitioners, and medical professionals. On April 27, 2012 a meeting transitioned Body Art Steering Committee that so ably planned and conducted the workshop, into a Body Art TAC (composed of Environmental Health staff) and a Body Art Working Group (composed of Environmental Health staff and body art practitioners). Between April 27 and the end of this reporting period, the Body Art TAC and Working Group, under the leadership of Greg Reyes developed resources to support agencies who will implement the law at the county level. Resources that have been completed or are nearly completed include: Standardized inspection form (Completed) General guidance document (Completed) Plan check guidelines (Nearly completed as of July 31, 2012) Temporary event guidance for sponsors/practitioners (Nearly completed as of July 31, 2012) Vehicle plan check guidance (Pending) Injury Prevention and Control Plan guidance (Pending) C. Organized Camp Law Revision In 2011, SB 737 (Walters) was introduced which would have made changes to the code sections governing organized camps as well as proposed additional language for organized day camps. The Governor vetoed this bill and asked CDPH and Social Services to work with the author to clarify and simplify the regulation of organized camps. Corwin Porter stepped forward to take the leadership role on this issue for the committee and participated in a working group composed of Department of Social Services (DSS), CDPH, California Collaboration for Youth (CCY), industry and education professionals was established. A consensus bill was developed that had no opposition. After passing the Senate policy committee, fiscal committee, and the Senate Floor with no "no" votes, the bill was referred to the Assembly Human Services Committee. The committee consultant assigned to review and prepare an analysis of the bill for the committee, Chris Reefe, felt the need to re-write the bill and recommended some 17 amendments. When the working group declined to adopt the amendments and the Chair asked that the staff work with the sponsors over the summer recess, Chris called together a "stakeholders" meeting to discuss adding the amendments he proposed before the bill would be heard in the Assembly Appropriations Committee. His stakeholders committee included a number of organizations that had not been involved with the bill, including the Parks and Recreation association, a Trustline advocate, the International Racket and Sports Association, the advocate for counties, and others. Representatives of the work-
4 PAGE 4 VI. ing group argued that the proposed amendments were not appropriate, would cost camps a significant amount of money, and that our support for the bill would be lost. Following the meeting, Chris privately briefed the Chair of the Committee on the working group s objections to his re-write of the measure, and the Chair decided to have the bill returned to his committee, effectively killing the bill since there are no more policy committee hearings scheduled. Among the final points upon which the working group could not agree are the following: 1) Removing language from the bill that allows camps to rent out their facilities for non-camp related activities such as adult retreats, family reunions and other activities that should not be required to meet the organized camp laws and regulations in order to hold their events. 2) The requirement to an FBI check on all teenage students and others (18 and above) before we can employ them. 3) Requiring a full time health supervisor to be present for all "day camp" activities (trips to the beach, parks etc.). As a result, Senator Walters is striking all sections of the bill except Sections 1 and 2 related to extending the hours ASES afterschool programs can operate, and expanding the license exempt recreation definition. We will re-introduce a measure similar to SB 1087 in January. D. Performance Measures Performance measures for Public Swim Pools and Spas were developed by Sean Debley and John Ramirez. Performance measures for housing and institutions were developed by Corwin Porter. Recommendations for Action during Next Reporting Period A. Body Art Program Development 1. Complete development of program development currently underway 2. Develop model program plan for body art B. Organized Camp Development 1. Form a TAC? 2. Develop a standardized application 3. Develop a standardized inspection form 4. Develop general guidance document 5. Consider sponsoring a CCDEH Organized Camp bill C. Public Swim Pools and Spas 1. Track and assist in revision to Title 22 if changes are proposed 2. Track and assist in Title 24 CCR package submitted to the Building Standards Commission for the 2012 Triennial Code Adoption Cycle 3. Track and assist in revision of Title 31 B
