1 BARBER AND BEAUTY CULTURE 1 Regulations Governing Barber and Beauty Culture Establishments, 1979 Repealed by Chapter P-37.1 Reg 10 (effective December 5, 2002). Formerly Saskatchewan Regulations 213/79 (effective August 1, 1979). NOTE: This consolidation is not official. Amendments have been incorporated for convenience of reference and the original statutes and regulations should be consulted for all purposes of interpretation and application of the law. 3 BARBER AND BEAUTY CULTURE 3 SASKATCHEWAN REGULATION 213/79 under The Public Health Act Section 73 Regulations under The Public Health Act Short Title 1 These regulations may be cited as Regulations Governing Barber and Beauty Culture Establishments, Interpretation 2 In these Regulations, unless the context otherwise requires, the expression: (a) approved means approved by the medical health officer; (b) barber means a person engaged or employed in barbering and also includes an apprentice who is so engaged or employed; (c) barber shop includes a barber shop, a ladies hairdressing, manicuring and beauty parlour, and also includes a training school for barbers or persons becoming trained in ladies hairdressing or manicuring into which members of the public are invited to enter for the purpose of receiving haircuts, hairdressing or manicuring, as the case may be, from the persons receiving the training; (d) barbering includes any work usually performed in a barber shop; (e) provincial epidemiologist means the person appointed as the Provincial Epidemiologist by the minister. 3 Aug 79 s2. Inspection 3(1) A medical health officer or public health inspector may enter any barber shop for purposes of inspection during usual hours of operation. (2) Every barber shop shall be inspected: (a) before commencing business; (b) before major alterations are made or additional barber chairs installed; (c) as often as required thereafter but not less frequently than once per year. 3 Aug 79 s3. Construction, Operation, Maintenance 4(1) No barber shop shall be operated in any premises where food or drink is served, prepared or stored, unless fully separated therefrom by a partition extending from floor to ceiling. (2) Barber shops shall be completely separate from living quarters.

4 4 BARBER AND BEAUTY CULTURE (3) There shall be a minimum of 14 square metres (150.7 sq. ft.) of working space for the first chair and at least 3 square meters (32.3 sq. ft.) for each additional chair. Additional space shall be provided for reception, supply storage, toilet, janitorial supply and equipment storage areas. (4) Every barber shop shall: (a) be lighted to an extent equivalent to at least lux (50 ft.) candles; (b) be well ventilated; (c) be maintained in a clean and sanitary condition; (d) have an approved water supply and plumbing system; and (e) make suitable arrangements for its patrons to use washroom facilities consisting of at least one water closet and one wash basin which is conveniently located and readily accessible to patrons. (5) Hair shall be frequently removed from floor and be deposited in a covered waste receptable. (6) Persons engaged in barbering shall: (a) be clean in their habits; (b) wear clean outer garments; (c) wash hands with soap and water immediately before serving each customer or student; and (d) refrain from smoking while performing barbering. 3 Aug 79 s4. Cleaning, Sanitizing and Care of Equipment and Supplies 5(1) No common article shall be used on any customer except a temporary cover or wrapper. (2) Hair brushes, combs, razors, scissors, clippers, rollers, clips, pins and other instruments of the trade shall be of such design and material as to be effectively cleaned and sanitized. Rollers shall be a type that have a smooth surface. (3) Hair brushes and combs shall be thoroughly cleaned daily with soap and hot water. Razors, scissors, clippers and other instruments of the trade shall be kept clean and shall be subject to an approved bactericidal process at least daily and oftener if so directed by the public health inspector, medical health officer or the minister. (4) Approved sanitizing processes shall consist of the following steps: (a) following removal of hair, items shall be thoroughly washed in hot water and soap or detergent; (b) items shall be thoroughly rinsed in clear water to remove all soap or detergent;

5 BARBER AND BEAUTY CULTURE 5 (c) items shall be completely immersed in: (i) chlorine solution having a strength of not less than 50 mg/1 for two minutes; or (ii) a solution containing a quaternary ammonium compound having a strength of not less than 100 mg/1 for two minutes; or (iii) in hot water of at least 82 C (180 F) for two minutes; or (iv) by such other approved sanitizing process or agent prepared specifically for sanitization of such tools, instruments and implements and used in accordance with the directions of the manufacturer. (5) All sanitized items shall be stored in a clean, dust-proof cabinet and kept free from contamination until used. (6) A sterilized cotton wad shall be used for application of cosmetics to one person. It shall then be deposited in a covered waste receptacle. (7) Automatic soap dispensers shall be used for shaving. Brushes and finger bowls shall be thoroughly cleaned and rinsed in hot water after each patron is served. (8) All clean linen shall be kept in enclosed, dust-proof storage until used. 3 Aug 79 s5. Customer Service 6(1) The headrest of the chair shall be covered by a clean towel or paper for each patron. (2) The wrapper or temporary cover shall not touch any skin about the face or neck. (3) A clean guard for each customer consisting of a freshly laundered towel, cloth or disposable soft paper guard shall be wrapped around the neckline and the wrapper then shall be placed around the shoulders. (4) Where used, freshly laundered towels shall be provided for each patron. Following use, towels shall be deposited in a covered container provided for that purpose. (5) Steamer towels shall not be re-used until washed. 3 Aug 79 s6. Product Prohibition and Uses Defined 7(1) Alum or other materials used to stop the flow of blood shall be applied in powdered or liquid form only. Liquids applied on sterilized cotton wool may be used. Following use, such cotton wool shall be immediately placed in a covered waste receptacle. (2) All other fluids, semi-fluids and powders shall be dispensed with a spatula or from a shaker, dispenser pump or spray type container.

6 6 BARBER AND BEAUTY CULTURE (3) No barber in any barber shop shall use any such substance injurious to skin or hair, or any such substance toxic to human beings when absorbed through the skin. 3 Aug 79 s7. Refusal of Services 8(1) A barber has the right to refuse service to a customer affected by a visible eruption, whose skin is broken, inflamed or contains pus or whose hair has evidence of infestation. (2) Whenever any patron affected in any way in the manner described in subsection (1) is served, the barber s hands shall immediately be thoroughly washed with hot water and soap, followed by disinfection with alcohol (70 to 80%) or a solution containing phenol of proper strength, or some equally efficient approved disinfectant. (3) The instruments used on such customers shall be thoroughly washed and subjected to a sanitizing process. Brushes and combs shall be immersed in the disinfectant used for ten (10) minutes. 3 Aug 79 s8. Communicable Diseases 9(1) A person who: (a) is or has been suffering from a communicable disease or skin infection; or (b) is a known carrier of a communicable disease; shall not be engaged in barbering until he has received written permission from the medical health officer. (2) When the Provincial Epidemiologist or the medical health officer has reason to believe a person who is barbering is infected with a communicable disease in a communicable form, the Provincial Epidemiologist or medical health officer may order in writing such person to report to a physician for any examination which may be considered necessary. The examining physician shall report to the Provincial Epidemiologist or medical health officer with regard to such examination. If such person fails or neglects to comply with such order, he shall immediately cease to do any barbering. 3 Aug 79 s9. Posting of Regulations 10 Every owner or manager of a barber shop shall have available on request a copy of these regulations. 3 Aug 79 s10.

7 BARBER AND BEAUTY CULTURE 7 Offence and Penalty 11(1) A person who infringes any of the provisions of these regulations, or fails to comply therewith or with any notice lawfully given thereunder, shall be guilty of an offense, and be liable on summary conviction to a penalty of not less than $5 nor more than $100. (2) The imposition of a penalty for failure to comply with a notice shall not relieve the person in default from carrying out the work therein mentioned, but he shall be liable on summary conviction to a further penalty of not less than $1 nor more than $10 for each day after the first penalty is imposed until he has complied with the notice. 3 Aug 79 s11.
