As a courtesy, please place any mobile phones, tablets or audible devices on silent mode. Please join me now as we stand and recite the Pledge of Allegiance and remain standing for a brief moment of silence. (Recitation of the Pledge of Allegiance.) THE CHAIRWOMAN: Let the record reflect that we have a quorum with Commissioners Adkison, Blanchard, Padgett, Garrison, Moldovan and Ward, and Commissioner Motes will be here. In attendance is our Duval County Public School's representative, Randy Gallup; and members of the City's Planning and Development Department; and Office of the General Counsel. This commission's bylaws provide that each member of the public who speaks before this commission is limited to a three-minute presentation. It is important that an accurate Diane M. Place -- everyone who wishes to speak must fill out a blue speaker's card, place them in the basket beside the speaker's podium. Cards are located near the podium and at the back of the room. The speaker's testimony is taken down by the court reporter, and it is important that participants speak clearly into the microphone and only one person should speak at a time. Any tangible material submitted with the speaker's presentation will become a part of the public record and will be kept by this commission; therefore, please retain a copy of anything submitted if it is needed. The public hearings on exceptions, variances, waivers, administrative deviations and minor modifications are quasi-judicial where you'll be sworn in prior to your testimony, and the decisions by the Planning Commission today will be final. Decisions by this commission on rezonings and land use amendments are recommendations only. The recommendations are transmitted to the City Council's Land Use and Zoning Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 Committee, which ultimately votes on these matters. LUZ may or may not follow the recommendations of the Planning Commission. Unless specifically deferred by LUZ, items voted on by the Planning Commission today are heard before the Land Use and Zoning Committee in two weeks. LUZ will meet on Tuesday, April th, 0, for another public hearing and vote. 3 Brown, and I would like to address this committee. My issue here is I would like to begin by saying I like walking, seven days a week, one and a half miles a day. The area in which I walk connects to a funeral home where they plan to change to a crematorium. This now becomes a health hazard to me and all who work, walk and play in the area. Oh, yes, there is a K- Catholic school about 0 to 0 yards away. It also has a Wendy's fast-food restaurant about 00 yards away. One of my biggest problems is this: Please, I desire you not to stop me from walking. If this crematorium is put up, that's one of the issues I'll face. I won't be able to walk in the area anymore due to the fact of the air atmosphere and the hazard it would present. Thank you for your time. THE CHAIRWOMAN: Thank you. Marilyn Brown? WRIGHT: Yes, according to all of the requirements for the zoning exemption, we actually meet them with flying colors. I understand Mr. Brown's concern about his walking, but if he's walking anywhere within the 0 feet that the zoning requires, then he's walking on their property. Their property is all on that whole -- sorry -- that whole area is their property. So in order to be anywhere in the vicinity of it, you're walking on their property. If he would like the paperwork and the air quality paperwork, I would gladly give it to him. Also, this crematorium is not like the old crematoriums that you get a big puff of black smoke out of. 4 by EPA, so it's not going to be effective to anyone's health, else it wouldn't be allowed. It's not like some of the old crematoriums in the city right now that are still operational in areas that are closed to residential areas. As far as the restaurant and the school that are next to it, the school building itself is actually thousands of yards away from where this is, and where the kids play is thousands of yards away from it, so it poses no safety hazard to no one. If you walk right next to the building, you still don't have a safety hazard at all. But all of the property surrounding this belongs to the Warden funeral home service. THE CHAIRWOMAN: Thank you. BELL: I'm president of our neighborhood association, Metro Garden Neighborhood Association, and we wholeheartedly are against this crematorium. We came before this body, a zoning commission, about eight years ago, when another funeral home also applied for a crematorium in the same area. We have the same opposition because of the health risks, the toxic fumes that's going to come from a crematorium. It used to be Shands Hospital, but it's Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 now UF Health. They had a crematorium there and they discontinued their crematorium because when people came out to the parking lot, the cars, all of the corpse ashes was on their cars. This is the same problem we're going to have in our neighborhood. Brentwood is an historic district. It has Gateway Shopping Center. It is the first shopping center here in Jacksonville. They just built -- the Catholic schools just built their new high school, which is about 00 feet away from where they proposed the crematorium. We have Wendy's. We have so many people that come into our area. We have the Norwood Flea Market. And I don't see where this crematorium will benefit anyone in our community. We have homeowners. My house is about seven years from 00 years old. So this community has been around a long time, and a crematorium is not a perfect fit for our community, aside from the health risk. This is a former Famous Amos restaurant. The request is to rezone the back portion of the property from Light Industrial to CCG-. The front portion already is CCG-. This would just unify the property under one zoning district. Staff has reviewed the application and finds that it is consistent with the Comp Plan. Also, the property does not abut any residential, so we don't think any neighbors would be affected by this. And with that, we are forwarding to you a recommendation to approve. This is down south of Dave & Buster's off of. The zoning exception is requesting retail sales, including outside display for a wholesale plant nursery. The zoning deviation AD-- is seeking to reduce the parking and some landscaping provisions. We have no objections to the rezoning exception request. We feel it is appropriate Diane M. However, this is a green site, being newly developed, and we felt that -- we didn't see a compelling reason why they couldn't comply with the site design requirements, so we forward to you a recommendation to approve the zoning exception but to deny the deviation. COMMISSIONER GARRISON: Thank you, Madam Chair. Question to the applicant through the Chair. Make a better case, if you would -- you're saying your parking is back in the woods so you don't think there should be -- can you break this down? MR. FOUNTAIN: I have no objection to the ADA requirements. We have a handicap ramp to go into our office. We have reconstituted asphalt as our ground. It's very, very stable. I'll put up a sign. That's not a problem. My only thing was the marked spaces for all of our parking. It didn't make any sense to me. If all they're asking for is a sign for handicap, absolutely, that's not a problem at all. As you can see in the photo of our office, we do have a wheelchair-accessible ramp. THE CHAIRWOMAN: Anyone else? Commissioner Adkison? COMMISSIONER ADKISON: Through the Chair, how many full-time employees actually work in Diane M. Tropia, Inc., P.O. Box, Jacksonville, FL 0 (0) -000 the office? MR. FOUNTAIN: We have two in the office and two in the field. COMMISSIONER ADKISON: Okay. And how many customers do you think will be coming in daily? MR. FOUNTAIN: Hopefully a lot. I'd say in the mornings, we have about 0 to landscapers that come in with their trailers and trucks. COMMISSIONER ADKISON: Okay. So they're coming in to move to the back to get loaded up and leave, but -- MR. FOUNTAIN: Yes, they drive to the back, and we have them ready for pickup. COMMISSIONER ADKISON: All right. Thank you. THE CHAIRWOMAN: Commissioner Blanchard? COMMISSIONER BLANCHARD: Thank you, Madam Chair. Through the Chair to the applicant, you realize that you're only required to have three parking spots, right? COMMISSIONER BLANCHARD: Yeah, I don't -- so are you -- are you saying that you're okay with having parking spots, you're okay with having dedicated parking spots; you just don't want them to be paved, or you want the ability to sort of park wherever it fits, or what are you saying? MR. FOUNTAIN: I'd like to keep it how it is, just reconstitute the millings, the ground that we currently have put down. It's compacted. It's rolled. It's just not paved, striped or curbed. They're asking for curbs and they're asking for stripes and they're asking for concrete edging around the whole... COMMISSIONER BLANCHARD: So -- so you're already operational? MR. FOUNTAIN: Yes. And we just began bringing plants in -- it's mainly a distribution center. Our main facility is in Homestead. It's 00 acres. So we just bring plants up here for our customers up here. 7 should not have to abide by these rules when everybody else does? MR. FOUNTAIN: I mean, if you look at other nurseries, not a lot of them have curbs and borders. This is in the middle of the forest. This isn't open to the public. This is landscapers only. COMMISSIONER BLANCHARD: So it's commercial only, so you won't have a lot of customers during the day -- MR. FOUNTAIN: Our customers are pretty much in the morning. That's it. The landscapers come and get their material and they go to their jobs. In the afternoon, it's just our workers pulling weeds, spraying, doing production. COMMISSIONER BLANCHARD: So just for clarity, it's not open to the public. It's wholesale only; is that correct? MR. FOUNTAIN: Yes. It's not open to the public. COMMISSIONER BLANCHARD: I'm still in the middle, but no further questions, Madam Chair. THE CHAIRWOMAN: Commissioner Ward? COMMISSIONER WARD: Through the Chair to Diane M. Tropia, Inc., P.O. Can somebody direct me where in our current book the actual requirements of the -- the parking requirements he's seeking the deviation from are listed out in writing? MR. HUXFORD: Those would be found in part of our zoning code, so they're not -- COMMISSIONER WARD: So they're not actually here? MR. HUXFORD: The parking requirements are part, which is our parking formulas, and then the landscaping requirements are found under part, which is our city landscape regulations. COMMISSIONER WARD: Thank you, Folks. And just as a follow-up through the Chair, Folks, would you say -- I'm not going to hold you to it, but generally the curb requirements, the striping, the full paving, everything that he's described as what is being asked for under the code that you just referenced, would you generally characterize that as correct? I'm just trying to get a feel for what exactly he's seeking a deviation from, and I don't have that in front of me. Diane M. Tropia, Inc., P.O. HUXFORD: The four deviations being requested are on the front page of the deviation report at the top. I don't know where the gentleman has interacted with. It may very well have come from Development Services, where the City's landscape architect resides. And we would not be asking for anything above and beyond whatever the minimum requirement is, but they're asking for relief from our minimum standards. COMMISSIONER WARD: Okay. Thank you, Folks. THE CHAIRWOMAN: Commissioner Adkison? COMMISSIONER ADKISON: Through the Chair to staff, I'm looking at a mobile trailer which is his office. That can be moved at any time in case he wants to develop it later, a building. But the ADA side -- the ADA path, it has to be concrete, right, and have a concrete ramp to that? You can discuss that in relation to the ADA requirements and what has to be their minimum requirements, but then also go through the other requests that they're requesting to see if you're willing to give them some relief from it, from the other items as well, but I think you need to discuss each of them individually. If you said, for example, "Hey, we're going to move this trailer in one year because we're building a building right here and we're going to do a whole new parking lot or we only use this road over here and no one ever parks here," or whatever it is, if there was some compelling evidence why the rules should be different for you and that's reasonable, but there aren't, other than I really don't want to build three parking spots because we're a landscape company. You've got to play by the rules. If you can make a compelling argument, I'll support you. I haven't heard it yet, and what we're Diane M. Tropia, Inc., P.O. I'm just being honest. And I see these six conditions, and I find it strange that RAP is giving conditions that need to be met in order for their blessing, when in fact it's our blessing that you truly need.
