3 FIAC Projects invites exhibitors to present artworks in exceptional conditions in direct proximity to their booth, in the prestigious context of the Petit Palais, on the Avenue Winston Churchill, pedestrianised every year during FIAC week. FIAC projects Instigated by FIAC, the pedestrianisation of the avenue has enabled the reconstruction of the original esplanade of the 1900 World Fair, thus connecting the Petit Palais and the Grand Palais. The ensemble creates an unprecedented platform to exhibit artworks within an historic museum context. This year, FIAC Projects is conceived in collaboration with Rebecca Lamarche-Vadel, curator at the Palais de Tokyo. In her capacity as invited curator, Rebecca Lamarche Vadel participates in the selection of artworks together with FIAC and the curatorial teams of the Petit Palais among works submitted by FIAC exhibitors and is responsable for the conception and design of the exhibition presented within the Petit Palais. Roosevelt THE SPACES PETIT PALAIS Built by the architect Charles Girault for the Exposition Universelle of 1900, the Petit Palais became the Musée des Beaux-Arts de la Ville de Paris in Its collections illustrate the principal artistic currents from Ancient Greece until World War I, together with the decorative arts. THE VENUES AVENUE WINSTON CHURCHILL AND GRAND PALAIS SURROUNDINGS Avenue Winston Churchill, which connects the Grand Palais and Petit Palais, is transformed into a pedestrian-only area during FIAC, thus recovering its initial function: during the World Fair for the inauguration of the two Palais in 1900, the avenue was reserved for foot traffic and gave its unity to this architectural complex. 5 APPLICATION DEADLINE: FRIDAY, JULY 5 TH 2019 application Application forms for FIAC Projects are available for completion online on our website: application.fiac.com Upon completion of all of the sections, you will be able to download your contract in PDF format. A copy of this document must be signed and returned by to the Artistic Programmes Department by Friday, July 5 th Results will be announced at the end of July APPLICATION CRITERIAS Only applications submitted by galleries accepted at FIAC 2019, or have participated to FIAC 2017 or 2018 at the Grand Palais will be reviewed by the Selection Committee. Galleries can apply to FIAC Projects before receiving the results of their application to FIAC Galleries at the Grand Palais. Galleries may submit several projects. Each project will be reviewed individually by the Selection Committee, before notification of admission or refusal. Projects may be submitted jointly with other galleries, exhibitor or not at FIAC Grand Palais. In this case, the applying gallery remains the only contractor and contact for the organization (responsibility, invoicing, insurances, logistics, etc.). Admitted projects must be realized according to the submitted description. Any artistic or conceptual changes after admission must be approved by the Selection Committee. The allocations of artworks are chosen by the Selection Committee, the technical and the curatorial staff of the Petit Palais and FIAC s programming team, depending on the technical and security constraints of presentation of the artwork. 5 Johan Creten, 8 Gods, , Almine Rech Marc Domage
6 PARTICIPATION FEE A flat rate of excl. tax is charged for each project exhibited, regardless of its format. A flat rate of excl. tax is charged for ensembles by a same artist of two and more artworks. All exhibitors agree to pay an inconvenience penalty of 50% of the flat fee, in the event that they withdraw from the contract after it has been confirmed, and on or after September 14 th Production, transport, installation, dismantling, tools and specific material, surveillance, insurance and maintenance of the artworks are the sole responsibility of the gallery. 7 GENERAL REGULATIONS FIAC PROJECTS Section 1 Description of the operations proposed by the organiser For the 2019 edition of FIAC, the organiser pursues its special operations, dedicated to artworks going beyond the scope of a regular gallery booth, that is, an exhibition of artworks in the following locations: Domaine national du Louvre et des Tuileries, Place Vendôme, Musée national Eugène Delacroix, Place de la Concorde, thanks to partnerships with the managing body of these prestigious venues. This operation shall be referred to hereafter as FIAC Hors les Murs. In parallel, the organiser holds FIAC Projects, dedicated to specific artworks presented outside the galleries booth, namely an exhibition of works on the Avenue Winston Churchill and surroundings of the Grand Palais as well as indoor spaces of the Petit Palais. This operation is hereinafter referred to as «FIAC Projects». The organiser reserves the right to add other locations to FIAC Hors les Murs and FIAC Projects. Space shall hereafter refer to the site in which the gallery selected for FIAC Hors les Murs or FIAC Projects exhibits its artwork. The exhibition time of these operations shall vary according to the exhibition space and the technical constraints of the artwork (contact organiser for more specifics). For such purposes, the organiser has issued a specific application form for each venue. Section 2 - Selection of galleries The galleries that wish to participate in FIAC Projects or FIAC Hors les Murs address the relevant application form to the organiser, duly signed and completed with all the paperwork requested. Only applications from galleries admitted into FIAC at the Grand Palais will be studied by the Selection committee of FIAC Projects or FIAC Hors les Murs (unless special authorisation from the organizer). Galleries may submit several projects. Each project will be reviewed individually by the Selection Committee of the venue for which the gallery applied before notification of admission or refusal. The organiser wishes to stress the fact that in order for a gallery to be definitively selected, a Civil Liability certificate must be returned imperatively before 14 September 2019, pursuant to the provisions of section 6. Failing this, the application will be systemically rejected, irrespective of the state of advancement within the selection process. It shall retain the participation fee and the Organiser may allocate the site to another gallery. The organiser verifies that the applications it receives are complete and signed. If so, the organiser submits the application to a Selection Committee relative to the exhibition venue, whose members are indicated on the FIAC website. The Selection Committee is solely responsible for: - Judging the artistic quality of the projects that are presented to it by the galleries and their conformity with the expectations of visitors to FIAC - Ensuring the artistic coherency between the various propositions/works. The Selection Committee s decisions are final and no correspondence shall be entered into. In the event of exhibition of artworks that do not comply with the quality requirements of FIAC, the organiser reserves the right to have the artworks in question removed from the exhibition space. In general terms, the deliberations and decisions of the Selection Committee are governed by section 4 of FIAC Special Regulations. Section 3 Attribution of locations It is also the role of the Selection Committee and the organiser to attribute a location in one of the Spaces to the galleries selected through the application process. Galleries may not request a specific site: the Selection Committee and the organiser are free to propose the location that they consider the most appropriate. This attribution shall be performed as per the conditions above, to which the following provisions shall be added: After consultation with the managing body of the Space in which the operation shall be implemented, the organiser establishes the map of the projects. Based on this map, the Selection Committee freely performs the assignment of locations, taking into account the specificities of each work and each location insofar as possible. For this attribution, the Selection Committee and the organiser take the conditions of access to the site where the work will be exhibited into account, as well as other technical specificities of the site. A technical file will be delivered to the galleries selected for the project, which will include a map of the location, with measurements, conditions of access to the site and its technical specificities. The organiser shall not be held liable if a difference arises between the measurements indicated on the map and the actual dimensions of the location. The same applies for any other technical indications. Some venues require following regulations imposed by the Police prefecture of Paris, the concerned arrondissement, the voirie, the city and any other public authority that can be related to the project, along with the exhibition space s own rules. Section 4 Installation and removal of artworks Technical files The gallery agrees without reserve or restriction to comply with the technical file for the operation for which it was selected. This file will be delivered to the gallery by the organiser and shall include: - The dates of arrival and departure of the works, - Instructions for clearing/cleaning and protecting the location used by the gallery, - Specific security and installation instructions - Specific regulations from the Space in which the artwork is presented, such as maximum weight. The rules contained in the technical file are imperatives. In general terms, the gallery agrees to comply with all instructions given by the organiser or the managing body of the Space concerned. The galleries agree to respect all prescriptions communicated by any local authorities and to its own costs. The galleries are aware of the fact that the venue selected for FIAC Projects and FIAC Hors les Murs are prestigious venues listed with the Monuments Historiques and particularly fragile, thus requiring special care and respect. The organiser reserves the right to expulse any gallery or subcontractor of the gallery if it is observed that (s)he violates the terms and conditions of the present regulations, the technical file or the instructions given by the managing body of the space concerned and/or the organiser. This regulation does not create an overall duty of surveillance on the part of the organiser. The gallery also agrees to provide the works requested by the organiser in the technical file within the time limits indicated. Failing this, the organiser reserves the right to freely dispose of the location allocated to the gallery. Works of art on display Light and sound installations The organiser, together with the Selection Committee, reserves the right to require that any light or sound piece which is detrimental to neighbouring exhibitors or to the public shall be removed or its location modified. A plan indicating its location on the exhibition space and its technical requirements must be presented beforehand. The organiser may have cause to request the displacement and/or removal of the artworks concerned and/or the installation of appropriate measures, which the exhibitor agrees to implement without delay. This clause shall not be interpreted to create a general obligation for the organiser to supervise the fact that the artworks on display present no form of danger, disturbance, or risk of damage. At all events, the exhibition of artworks is undertaken at the exhibitor s sole liability and under their surveillance. At all events, the exhibition of artworks is undertaken at the gallery s sole liability and under their surveillance. Installation / Removal It is hereby specified that in terms of installation and removal, the organiser shall only provide basic technical support; the full responsibility of these operations shall be incumbent to the gallery. The gallery shall be responsible for all of the costs relating to its participation in the operation, such as installation, transportation, insurance and equipment hire or purchasing costs, as well as covering the artists expenses. The gallery agrees to respect the deadlines and the installation and removal conditions that will be provided by the organiser in the technical file, and the local authorities if needed. Failure on the gallery s part to comply with the deadline or the conditions of occupation of sites authorises the organiser to claim payment in late fees and damages. Specifically concerning dismantling, removal and clean up, the organiser may undertake any operations that have not been completed by the gallery within the agreed time limits, at the expense and risk of the gallery. The galleries occupy the sites in the state in which they find them and must leave them in the same condition. Both the gallery and the organiser shall sign a form regarding the state of entry and exit of the site. These documents are available from the organiser. They shall prevail in the event of an accident, without contest on the part of the gallery. The repair of any deterioration caused by a gallery or its installations, materials or goods, shall be at the expense of the said gallery, as well as any cleaning, rehabilitation, transportation, indisputably. 7 Reijiro Wada, Still Life, 2006, Scai the Bathhouse Marc Domage
8 Each gallery provides, at its own expense, for its own transport, reception and installation of the artworks and/or the materials that they require. It agrees to comply with the organiser s instructions pertaining to the regulation of the entrance and exit of artworks/materials, namely concerning the circulation of vehicles within the perimeters the projects exhibition spaces. INSURANCE / LIABILITY Section 5 Liability of the organizer The gallery holds full responsibility for producing the exhibition (installation and dismantling included). The organiser: 1. Provides the gallery with a prestigious exhibition space and only requires technical and logistical fees, specified in the specific application file for FIAC Hors les Murs or FIAC Projects. 2. Assists the gallery during installation and removal by providing basic technical support. The organiser s civil liability shall not be engaged within the framework of any of these operations. 3. The organiser remains the gallery s sole interlocutor; under no circumstances shall the gallery formulate any form of claim to the manager of the venue. Conservation of artworks and equipment Liability Artworks and all of the elements and equipment brought to its stand throughout the fair shall remain the exhibitor s sole responsibility and risk 24 hours a day, 7 days a week, during transport to and from the venue (stand included), handling, installation, and dismantling included. Under no circumstances shall the organiser be held liable concerning any of these elements. We draw the exhibitor s particular attention to the fact that the premises in which the FIAC Hors les Murs and FIAC Projects is held may expose artworks and other equipment to accidents (falls, leakage, theft, loss, etc.) owing to their age and/ or the atypical character inherent to the event. The exhibitor expressly accepts sole responsibility for providing cover for all of the risks thereof. While respecting the security regulations, (s) he must take all measures likely to protect the artworks and equipment against said risks; under no circumstances shall these measures be incumbent to the organiser. It is notably the exhibitor s role to decide the conditions of surveillance of said artworks and equipment (such as secure hanging, assigning of its own guards at the stand, etc.). Some of the venues hosting FIAC Hors les Murs or FIAC Projects, such as the Petit Palais, have their own surveillance staff, since they are public establishments, only said staff is authorized to move within the exhibition sites outside of public opening hours. Therefore, the gallery accepts that these artworks may not be under surveillance by its own guards or attendants outside of public opening hours. It also agrees not to formulate any grievance against the organisation and the place of exhibition in this regard and thus accepts full liability thereto. This condition is essential and determining for the Organiser s consent to the present agreement. Any specific prescription and request of surveillance imposed by the local authorities, the venue, or the organizer must be e satisfied by the gallery and is at his expense. The exhibitor is reminded that the insurance subscribed to via the organiser does not cover the artworks and that is therefore the exhibitor s role to insure them, by communicating all pertinent information to its insurer, notably the information contained in the special and general condition of the Fair. Section 6 - Liability of the gallery Only the gallery is liable for any damage that the set-up, exhibition, and dismantling of its artwork creates (notably damage caused to the exhibition site or bodily injury.) It agrees to pay the organiser, upon their first request, all of the amounts requested by them in this capacity. The galleries have an obligation to insure themselves against any forms of damage (material, physical or consequential) that they may create within the framework of the operation they are participating in. The organiser shall assume no responsibility thereof. The gallery must provide, before 14 September 2019, a civil liability insurance certificate covering it against the financial consequences of its liability, to a level of per claim for physical injury, and per claim for material and consequential damage. Section 7 - Insurance of the artworks, goods, artists and media presented The galleries must insure the materials and artworks for their total value, as well as the artists that they are presenting against all damages that the aforementioned may sustain within the framework of said operation. The organiser shall assume no responsibility thereof. INTELLECTUAL PROPERTY Section 8 - Concession of rights / Guarantee of peaceful enjoyment The gallery guarantees the organiser and the managing body of the spaces concerned that it has obtained from the intellectual property rights-holders all of the rights and/or authorisations required in the creations that it intends to exhibit, for the presentation of said creations within the framework of the operation described in section 1. The organiser and the managing body of the spaces concerned shall not be held liable in this domain. The gallery authorises the organiser and the managing body of the spaces concerned to reproduce and represent these creations free of charge. For the organiser: in the communication tools for the Fair (Internet, exhibition catalogue, invitations, visitors map, promotional video etc.) and more generally in any medium designed to promote the Fair (photographs of the Fair for publication in traditional media or on the Internet, television show produced about / during the Fair etc). For the managing body of the spaces concerned: in its entire promotional media and, more generally, in all media designed to promote the operation. The gallery guarantees the organiser and the managing body of the spaces concerned that: - It has obtained from the intellectual property rights-holders in these creations, all of the rights and/or authorisations required for the above-mentioned utilisations. - It has settled the rights with the collective rights-management organisations concerned; the said rights must correspond to the utilisations of the work made by the organiser within the framework of the present operation. The present authorisation is granted for a term of ten years. Section 9 - Collective rights management body In the absence of an agreement between the organisations that collect and distribute copyright payments (the SACEM / ADAGP) and the organiser, the gallery deals directly with these organisations if it makes use of music, films etc. in any manner whatsoever within the context of the Fair. The organiser shall assume no responsibility thereof. The organiser may, at any time, request that the gallery produce the relevant proof pertaining to such use of copyrighted material. MISCELLANEOUS Section 10 - Security The gallery agrees to respect the security measures imposed by the nature of the artworks, their exhibition, or by the administrative or legal authorities, as well as any security measures that may have been taken by the organiser. The organiser reserves the right to verify compliance with these measures. Surveillance is provided under the organiser s control: its decisions concerning the application of security rules must be implemented immediately. Section 11 - Customs It is each gallery s responsibility to accomplish the customs formalities for the materials and artworks brought into the country from abroad. The organiser shall not be held liable for any difficulties that may arise with respect to such formalities. Section 12 - Application of the FIAC General Regulations Sections 34 and 35 of the FIAC General Regulations apply to the operations. THE BOND BETWEEN THE EXHIBITOR AND THE ORGANISER IS ENTIRELY AND EXCLU- SIVELY GOVERNED BY FRENCH LAW.
